SENATE AMENDMENT 2, To 1995 SENATE BILL 117

SB117-SA2,1,1 At the locations indicated, amend the bill as follows:

SB117-SA2,1,2 1. Page 2, line 1: before that line insert:

SB117-SA2,1,3 " Section 1g. 340.01 (46m) (b) of the statutes is amended to read:

SB117-SA2,1,8 340.01 (46m) (b) If the person has 2 or more prior convictions, suspensions or revocations, as counted under s. 343.307 (1), or if there was a minor passenger in the motor vehicle at the time of the violation, a blood alcohol concentration of 0.08% or more by weight of alcohol in the person's blood or 0.08 grams or more of alcohol in 210 liters of the person's breath.".

SB117-SA2,1,10 3. Page 6, line 10: after that line insert:

SB117-SA2,1,11 " Section 10g. 346.63 (5) (a) of the statutes is amended to read:

SB117-SA2,1,16 346.63 (5) (a) No person may drive or operate a commercial motor vehicle while the person has an alcohol concentration of 0.04 or more but less than 0.1. If there was a minor passenger in the commercial motor vehicle at the time of the violation, no person may drive or operate a commercial motor vehicle while the person has an alcohol concentration of 0.04 or more but less than 0.08.

SB117-SA2, s. 10m Section 10m. 346.63 (6) (a) of the statutes is amended to read:

SB117-SA2,2,7 346.63 (6) (a) No person may cause injury to another person by the operation of a commercial motor vehicle while the person has an alcohol concentration of 0.04 or more but less than 0.1. If there was a minor passenger in the commercial motor vehicle at the time of the violation, no person may cause injury to another person by the operation of a commercial motor vehicle while the person has an alcohol concentration of 0.04 or more but less than 0.08.".
