SENATE AMENDMENT 1, To 1995 SENATE BILL 307

SB307-SA1,1,1 At the locations indicated, amend the bill as follows:

SB307-SA1,1,3 1. Page 2, line 2: delete "exchange lands" and substitute: "exchange protected lands, as defined in s. 144.9405 (1) (d)".

SB307-SA1,1,4 2. Page 2, line 13: after that line insert:

SB307-SA1,1,5 " Section 2m. 30.20 (2) (b) of the statutes is repealed.".

SB307-SA1,1,6 3. Page 2, line 25: after that line insert:

SB307-SA1,1,7 "(d) "Protected land" means land that is any of the following:

SB307-SA1,1,8 1. A wilderness area.

SB307-SA1,1,9 2. A wild or scenic river.

SB307-SA1,1,10 3. A state park.

SB307-SA1,1,11 4. A wildlife refuge or area.

SB307-SA1,1,12 5. A state natural area, as defined in s. 23.27 (1) (h).

SB307-SA1,1,13 6. A wetland, as defined in s. 23.32 (1).

SB307-SA1,1,15 7. Any area that provides habitat for an endangered species, as defined in s. 29.415 (2) (a), or a threatened species, as defined in s. 29.415 (2) (b).

SB307-SA1,2,2 8. Any area that contains a high-quality example of a native plant or animal community.

SB307-SA1,2,4 9. Any area that has significant value as a preserve or reservoir of genetic or biological diversity.

SB307-SA1,2,5 10. A listed property, as defined in s. 44.31 (4).

SB307-SA1,2,6 11. A burial site, as defined in s. 157.70 (1) (b).

SB307-SA1,2,7 12. An archaeological site, as defined in s. 44.47 (1) (b).

SB307-SA1,2,8 13. Any area that has qualities that are rare or unique in this state.

SB307-SA1,2,9 14. Any area on which there is significant public recreational use.

SB307-SA1,2,10 15. Any area that is part of a scenic vista or used to view a scenic vista.

SB307-SA1,2,11 16. In the Lower Wisconsin State Riverway, as defined in s. 30.40 (15).

SB307-SA1,2,12 17. A public hunting or fishing grounds under s. 29.555.

SB307-SA1,2,13 18. A trail designated under s. 23.115 (1), 23.17 (2) or 23.175 (2) (a).

SB307-SA1,2,17 19. Located in Sawyer county in the vicinity of the Chippewa flowage and was purchased from the Northern States Power Company or located in Iron county in the vicinity of the Turtle-Flambeau flowage and was purchased from the Chippewa and Flambeau Improvement Company.".

SB307-SA1,2,18 4. Page 3, line 1: after "on" insert "protected".

SB307-SA1,2,21 5. Page 3, line 2: delete the material beginning with "This" and ending with "(2)." on line 3, and substitute: "No person may engage in mining beneath the bed of a navigable lake.".

SB307-SA1,2,22 6. Page 3, line 11: after that line insert:

SB307-SA1,2,23 " Section 3m. 144.942 (4) of the statutes is amended to read:

SB307-SA1,3,6 144.942 (4) No person may conduct drilling operations for the exploration for or production of oil or gas from beneath the beds of the Great Lakes or bays or harbors that are adjacent to the Great Lakes, unless all drilling operations originate from locations above and on the landward side of the ordinary high-water mark and are conducted according to the terms of a written lease obtained from the department under s. 30.20 (2) (b).".
