AB100-ASA1, s. 2734m 8Section 2734m. 115.361 (3) (a) and (b) of the statutes are amended to read:
AB100-ASA1,1232,159 115.361 (3) (a) A school board may apply to the department state
10superintendent
for a grant to fund a families and schools together program designed
11to identify pupils who are 6 to 11 years of age who have a high risk of dropping out
12of school, experiencing alcohol and other drug abuse problems or being adjudged
13delinquent. The program shall provide prevention and early intervention activities
14involving joint school, family and community participation, including mental health
15and alcohol and other drug abuse program specialists.
AB100-ASA1,1232,2116 (b) Beginning in the 1990-91 school year and annually thereafter, the
17department state superintendent may award grants of up to $50,000 to school
18districts with small and medium memberships and grants of up to $70,000 to school
19districts with large memberships. Grants shall be awarded from the appropriation
20under s. 20.255 (2) (dm). In this paragraph, "membership" has the meaning given
21in s. 121.004 (5).
AB100-ASA1, s. 2735m 22Section 2735m. 115.361 (4) of the statutes is amended to read:
AB100-ASA1,1233,223 115.361 (4) Grants for pupil alcohol and other drug abuse program projects.
24(a) The department state superintendent may award grants of up to $1,000 to a
25participating school district for alcohol and other drug abuse education, prevention

1or intervention programs designed by the pupils enrolled in the school district. The
2school district shall use the funds for the costs of the projects.
AB100-ASA1,1233,53 (b) Grants under this subsection shall be awarded from the appropriation
4under s. 20.255 (2) (dm). To the extent possible, the department state superintendent
5shall ensure that grants are equally distributed on a statewide basis.
AB100-ASA1, s. 2736m 6Section 2736m. 115.361 (5) (a), (b) (intro.) and 3. (intro.) and (c) (intro.) and
73. of the statutes are amended to read:
AB100-ASA1,1233,118 115.361 (5) (a) A school board, with the cooperation and support of a
9community-based organization, may apply to the department state superintendent
10for a grant of up to $30,000 to fund an after-school or summer school program for
11pupils in grades 1 to 9.
AB100-ASA1,1233,1612 (b) (intro.) The department state superintendent shall award grants under this
13subsection from the appropriation under s. 20.255 (2) (dm). The amount of a grant
14may not exceed 80% of the cost of the program, including in-kind contributions. The
15department state superintendent may award a grant to a school board under this
16subsection only if all of the following apply:
AB100-ASA1,1233,2317 3. (intro.) The program includes a school tutoring program operated by the
18school board or the community-based organization for pupils in grades 1 to 9 who
19are one or more years behind their age group in reading, writing or mathematics or
20who exhibit other significant academic deficiencies, including poor school

may consider whether any of the following applies to the program in
23determining whether to award a grant:

AB100-ASA1, s. 2738m 5Section 2738m. 115.361 (7) (a) (intro.), (b) and (c) of the statutes are amended
6to read:
AB100-ASA1,1234,97 115.361 (7) (a) (intro.) Of the amount in the appropriation under s. 20.255 (2)
8(dm), annually the department state superintendent shall allocate the following
9amounts for the following programs:
AB100-ASA1,1234,2010 b) Annually, the department state superintendent shall determine whether the
11amount allocated for each program under par. (a) will be fully utilized based upon
12the applications received that meet the specified criteria for each program. If an
13amount will not be fully utilized, the department state superintendent may transfer
14the unutilized funds to programs for which qualified applications exceed the
15amounts allocated. The transfer shall be made by November 1 of each school year,
16except that in any school year in which a biennial budget act takes effect, the transfer
17shall be made by November 1 or within 120 days after the effective date of the
18biennial budget act, whichever is later. Annually, the department state
19superintendent
shall submit a report to the joint committee on finance describing all
20transfers under this paragraph.
AB100-ASA1,1234,2521 (c) The department state superintendent shall collect and analyze information
22about the programs funded under this section, evaluate their effectiveness and
23submit a report of the evaluation to the appropriate standing committees of the
24legislature under s. 13.172 (3) and to the governor by July 1, 1994, and biennially by
25July 1 thereafter.
AB100-ASA1, s. 2741m
1Section 2741m. 115.3615 of the statutes is amended to read:
AB100-ASA1,1235,13 2115.3615 Head start supplement. From the appropriation under s. 20.255
3(2) (eh), the department state superintendent shall distribute funds to agencies
4determined by the department state superintendent to be eligible for designation as
5head start agencies under 42 USC 9836 to provide comprehensive health,
6educational, nutritional, social and other services to economically disadvantaged
7children and their families. The department state superintendent shall distribute
8the funds in a manner consistent with 42 USC 9831 to 9852 except that there is no
9matching fund requirement. The department state superintendent shall give
10preference in funding under this section to an agency that is receiving federal funds
11under 42 USC 9831 to 9852. Funds distributed under this section may be used to
12match available federal funds under 42 USC 9831 to 9852 only if the funds are used
13to secure additional federal funds for the purposes under this section.
AB100-ASA1, s. 2745ag 14Section 2745ag. 115.362 (4) (a) of the statutes is amended to read:
AB100-ASA1,1235,1915 115.362 (4) (a) Each school board receiving a grant under sub. (2) (a) 2. shall
16ensure that its program meets standards established by the department state

by rule. The school board may establish the program individually
18or on a cooperative basis with one or more school districts, cooperative educational

22establishing criteria for the awarding of grants under sub. (2) (a). The rules shall
23require that the department state superintendent give priority in awarding grants
24to school districts in which no pupil assistance program is available.

2of the blind shall make recommendations as to procedures and policies affecting any

4on such services, activities, programs, investigations and researches as in its
5judgment will contribute to the welfare of visually handicapped persons. The
6department state superintendent shall seek the advice of and consult with the
7council on problems and policy changes affecting the visually handicapped in the
8department's jurisdiction, and the council may initiate consultations with the
9department. Notwithstanding any provision to the contrary, the council shall have
10access to files, records and statistics kept in the department which relate to matters
11concerning the visually handicapped.
AB100-ASA1, s. 2745g 12Section 2745g. 115.375 of the statutes is renumbered 36.54, and 36.54 (1) and
13(2) (b), (c) and (d), as renumbered, are amended to read:

15department state superintendent of public instruction in identifying needs and
16establishing priorities for environmental education in public schools, including
17needs for teacher training, curriculum development and the development and

shall seek the advice of the environmental education board in
20carrying out these activities.
AB100-ASA1,1236,2421 (b) The environmental education board shall consult with other state agencies,
22including the university of Wisconsin-extension, conservation and environmental
23groups, youth organizations and nature and environmental centers in identifying
24needs and establishing priorities for environmental education.

1(2) (b) From the appropriations under s. 20.255 (1) (jr) and (2) (ee) and (ra)
220.285 (1) (ee), (j), (r) and (rc), the environmental education board shall award grants
3to corporations and public agencies for the development, dissemination and
4presentation of environmental education programs. Programs shall be funded on an
518-month basis. The environmental education board may not award a grant unless
6the grant recipient matches at least 25% of the amount of the grant. Private funds
7and in-kind contributions may be applied to meet the matching requirement.
8Grants under this paragraph may not be used to replace funding available from other
9sources.
AB100-ASA1,1237,1610 (c) The environmental education board shall promulgate rules establishing the
11criteria and procedures for the awarding of grants for programs and projects under
12par. (b). The environmental education board shall use the priorities established
13under sub. (1) for awarding grants if the amount in the appropriations under s.
1420.255 (1) (jr) and (2) (ee) and (ra) 20.285 (1) (ee), (j), (r) and (rc) in any fiscal year
15is insufficient to fund all applications under this subsection. The department shall
16assist the board in administering this section.
AB100-ASA1,1237,1817 (d) The environmental education board shall seek private funds for the purpose
18of the grants under this subsection.

20regarding how the programs and operations of the identified school districts and
21schools may be improved and periodically assess school district implementation of
22the recommendations.

19department state superintendent shall give preference to minority group pupils who
20are inadequately represented in the technical college and university of Wisconsin
21systems.
AB100-ASA1, s. 2749r 22Section 2749r. 115.44 of the statutes is amended to read:
AB100-ASA1,1241,4 23115.44 Early identification program. (1) The department state
24superintendent
shall establish an early identification program as part of the
25Wisconsin educational opportunity program under s. 115.28 (23). Early

1identification program costs shall be paid from the appropriation under s. 20.255 (1)
2(a). The early identification program shall assist minority and economically
3disadvantaged pupils in grades 8 to 12 in pursuing higher educational opportunities
4by providing direction toward attainment of career goals.
AB100-ASA1,1241,10 5(2) Biennially, the department state superintendent shall provide the governor
6and any appropriate standing committee of the legislature information on the
7performance of the early identification program and the postsecondary educational
8progress of the pupils who were enrolled in the program. The information shall
9include the number and ethnic backgrounds of the pupils who were enrolled in the
10program and college acceptance, retention and graduation rates of the pupils.
AB100-ASA1, s. 2085 11Section 2085. 115.45 (2) and (3) of the statutes are amended to read:
AB100-ASA1,1241,2012 115.45 (2) (a) Annually by September 15, the school board, on its own initiative
13or upon receipt of an application from the principal of an elementary school located
14in the school district, may apply to the department state superintendent for a grant
15under this section. The application shall include a plan specifying how the school
16board intends to meet the requirements under sub. (4), explaining the school board's
17selection process for individual schools and private service providers and identifying
18the schools in the school district, or the private service providers certified by the
19school board as providing the services under sub. (4) (b), to which the grant funds will
20be applied.
AB100-ASA1,1242,221 (b) The council for Milwaukee public schools grant programs under s. 115.28
22(20) shall review the applications submitted under par. (a) and make
23recommendations to the secretary state superintendent regarding the schools to be
24selected and amounts of the grants to be awarded. The council's recommendations

1shall be based upon and include information regarding the degree to which the
2proposed projects will effectively meet the requirements under sub. (4).
AB100-ASA1,1242,8 3(3) The department state superintendent shall determine the amount of the
4grant, if any, to be awarded a school board submitting an application under sub. (2)
5(a). Amounts awarded shall be paid from the appropriation under s. 20.255 (2) (do).

7elementary school programs and not to supplant or replace funds otherwise available
8for such programs.

12state superintendent shall determine whether the project met its objectives. A grant
13may not be renewed unless the department state superintendent determines that
14the project met its objectives.

AB100-ASA1,1244,2511 115.52 (3) All the blind and the deaf residents of this state 6 to 20 years old,
12and for the duration of a school term all the blind or deaf residents of this state who
13become 21 years old during that school term, who are capable of receiving instruction
14shall be received and taught in the schools free of charge. Like nonresident pupils
15also may be received upon payment in advance of the fees fixed by the department
16state superintendent at an amount not less than $75 per month, but no nonresident
17shall be received to the exclusion of a resident pupil. The department state
18superintendent
also may admit pupils who are 21 years of age or older prior to the
19beginning of a school term upon the payment of fees fixed by the superintendent and
20upon the recommendation of the secretary of health and family services, the director
21of the technical college system or the superintendent of the school to which the pupil
22will be assigned. All pupils shall equally and freely enjoy the benefits and privileges
23of the schools and have the use of the library and books of instruction and receive
24board, lodging and laundry, without discrimination. The schools may provide
25transportation for resident pupils.

1Section 2753f. 115.52 (5) of the statutes is amended to read:
AB100-ASA1,1245,72 115.52 (5) The department state superintendent may grant approval for the
3maintenance of a summer school at the school for the deaf whenever it will be to the
4advantage of deaf persons and may grant approval for the maintenance of a summer
5school at the school for the visually handicapped whenever it will be to the advantage
6of visually handicapped minors. There shall be a summer school each year at the
7school for the visually handicapped for visually handicapped adults.
