AB100-ASA1,17,9 13.90 (8) The joint committee on legislative organization may designate a joint committee or another body within the legislative branch to oversee the provision of information technology support and services by the integrated legislative information system staff.

AB100-ASA1, s. 14p Section 14p. 13.92 (1) (d) of the statutes is repealed.

AB100-ASA1, s. 14r Section 14r. 13.93 (2) (k) of the statutes is created to read:

AB100-ASA1,17,14 13.93 (2) (k) Pay, from the appropriation under s. 20.765 (3) (a), the expenses of attendance at meetings of members of the Commission on Uniform State Laws who are appointed by the governor.

AB100-ASA1, s. 12 Section 12. 13.94 (1) (eg) of the statutes is amended to read:

AB100-ASA1,17,21 13.94 (1) (eg) Annually conduct a financial audit of the gaming board division of gaming in the department of administration and biennially conduct a performance evaluation audit of the gaming board division of gaming in the department of administration. The legislative audit bureau shall file a copy of each audit report under this paragraph with the department of justice and with the distributees specified in par. (b).

AB100-ASA1, s. 13 Section 13. 13.94 (1) (em) of the statutes is amended to read:

AB100-ASA1,18,5 13.94 (1) (em) Annually conduct a financial audit of the state lottery, and, to the extent of the department of revenue's participation, of any multistate multijurisdictional lotteries in which the state participates under ch. 565, and biennially conduct a performance audit of the state lottery and, to the extent of the department of revenue's participation, of those multistate multijurisdictional lotteries, as provided in s. 565.37 (1). The legislative audit bureau shall file a copy of each audit report under this paragraph with the department of justice and with the distributees specified in par. (b).

AB100-ASA1, s. 14 Section 14. 13.94 (1s) (bm) of the statutes is amended to read:

AB100-ASA1,18,9 13.94 (1s) (bm) The legislative audit bureau may charge the gaming board department of administration for the cost of the audits required to be performed under sub. (1) (eg).

AB100-ASA1, s. 15 Section 15. 13.94 (7) of the statutes is repealed.

AB100-ASA1, s. 18m Section 18m. 13.96 of the statutes is created to read:

AB100-ASA1,18,17 13.96 Integrated legislative information system staff. There is created a service agency known as the "Integrated Legislative Information System Staff", headed by a director. The integrated legislative information system staff shall be strictly nonpartisan and shall at all times observe the confidential nature of the data and information originated, maintained or processed by electronic equipment supported by it.

AB100-ASA1,18,20 (1) Duties of the staff. The integrated legislative information system staff shall provide and coordinate information technology support and services to the legislative branch.

AB100-ASA1,18,22 (2) Duties of the director. The director of the integrated legislative information system staff shall:

AB100-ASA1,18,23 (a) Direct the operations of the staff.

AB100-ASA1,18,24 (b) Employ, train and supervise the personnel assigned to the director.

AB100-ASA1,19,2 (c) Supervise all expenditures of the integrated legislative information system staff.

AB100-ASA1,19,4 (d) Oversee the execution and completion of all contracts for legislative information technology-related equipment, software or services.

AB100-ASA1,19,6 (e) Plan for and execute such electronic information programs and services as are needed within the legislative branch.

AB100-ASA1,19,8 (f) Participate in such midwest and national meetings and organizations as will benefit the operations of the integrated legislative information system staff.

AB100-ASA1, s. 16 Section 16. 14.017 (2) of the statutes is amended to read:

AB100-ASA1,19,25 14.017 (2) State council on alcohol and other drug abuse. There is created in the office of the governor a state council on alcohol and other drug abuse consisting of the governor, the attorney general, the secretary of education state superintendent of public instruction, the secretary of health and social services, the commissioner of insurance, the secretary of corrections, the secretary of transportation and the chairperson of the pharmacy examining board, or their designees; a representative of the controlled substances board; a representative of any governor's committee or commission created under subch. I of ch. 14 to study law enforcement issues; 6 members, one of whom is a consumer representing the public at large, with demonstrated professional, research or personal interest in alcohol and other drug abuse problems, appointed for 4-year terms; a representative of an organization or agency which is a direct provider of services to alcoholics and other drug abusers; a member of the Wisconsin County Human Service Association, Inc., who is nominated by that association; and 2 members of each house of the legislature, representing the majority party and the minority party in each house, chosen as are the members of standing committees in their respective houses. Section 15.09 applies to the council.

AB100-ASA1, s. 17 Section 17. 14.20 of the statutes is created to read:

AB100-ASA1,20,2 14.20 Literacy improvement. (1) In this section:

AB100-ASA1,20,3 (a) "Local governmental unit" has the meaning given in s. 16.97 (7).

AB100-ASA1,20,4 (b) "Nonprofit organization" has the meaning given in s. 108.02 (19).

AB100-ASA1,20,7 (2) From the appropriation under s. 20.525 (1) (f), the governor may provide a grant to any local governmental unit or nonprofit organization for support of a literacy improvement program.

AB100-ASA1,20,11 (3) The governor shall cooperate with the department of administration in providing free books to organizations under s. 16.23 (1) and in seeking resources from foundations and private donors to support the department's function under s. 16.23 (2).

AB100-ASA1,20,14 (4) The governor shall accept requests from organizations qualifying under s. 16.23 (1) to receive free books and forward them to the Public Enrichment Foundation.

AB100-ASA1, s. 23j Section 23j. 14.26 (5g) (c) of the statutes is amended to read:

AB100-ASA1,20,18 14.26 (5g) (c) Accept gifts, grants, bequests or donations of personal services. All moneys received under this paragraph after September 30, 1998, shall be deposited in the historical legacy trust fund.

AB100-ASA1, s. 23k Section 23k. 14.26 (5g) (e) of the statutes is amended to read:

AB100-ASA1,20,21 14.26 (5g) (e) License products. All moneys received under this paragraph after September 30, 1998, shall be deposited in the historical legacy trust fund.

AB100-ASA1, s. 23m Section 23m. 14.26 (5g) (f) of the statutes is created to read:

AB100-ASA1,20,24 14.26 (5g) (f) Apply to the department of administration for a historical grant under s. 16.25.

AB100-ASA1, s. 23n Section 23n. 14.26 (5g) (f) of the statutes, as created by 1997 Wisconsin Act .... (this act), is repealed.

AB100-ASA1, s. 23p Section 23p. 14.26 (6) of the statutes is amended to read:

AB100-ASA1,21,8 14.26 (6) The commission shall complete its activities and submit a final report regarding its activities to the governor, and to the legislature under s. 13.172 (2) no later than June 1, 1999. Upon acceptance of the report by the governor, the governor shall notify the director of the historical society of his or her acceptance of the report and the commission shall cease to exist.

AB100-ASA1, s. 18 Section 18. 14.40 (1) of the statutes is amended to read:

AB100-ASA1,21,16 14.40 (1) Annually not later than July 1, each legislative, administrative and judicial agency of the state government shall submit to the secretary of state a list of all positions within that agency outside the classified service and above the clerical level, excluding the faculties under the jurisdiction of the board of regents of the University of Wisconsin System and the department of education public instruction, which are filled by appointment, and the term if there is one, together with the name of the incumbent and the date of his or her appointment.

AB100-ASA1, s. 19 Section 19. 14.563 (title) of the statutes is repealed.

AB100-ASA1, s. 20 Section 20. 14.563 (1) of the statutes is renumbered 15.103 (4) and amended to read:

AB100-ASA1,21,23 15.103 (4) Division of trust lands and investments. There is created a division of trust lands and investments which is attached to the office of the state treasurer department of administration under s. 15.03. This division is under the direction and supervision of the board of commissioners of public lands.

AB100-ASA1, s. 21 Section 21. 14.82 (1) (intro.) of the statutes is amended to read:

AB100-ASA1,22,21 14.82 (1) Minnesota-Wisconsin. (intro.) There is created a commission of 5 citizens nominated by the governor, and with the advice and consent of the senate appointed, for staggered 5-year terms, to represent this state on the joint Minnesota-Wisconsin boundary area commission. Any vacancy shall be filled for the balance of the unexpired term. To assist the commission, there is created a legislative advisory committee comprising 4 senators and 6 representatives to the assembly appointed as are the members of standing committees in their respective houses, and a technical advisory committee of 2 members appointed by the governor and one member each appointed by the governing board or head of the following agencies, to represent such agencies: the department of justice, the department of administration, the department of agriculture, trade and consumer protection, the department of natural resources, the department of health and family services, the public service commission, the department of tourism and the department of commerce. The members of the commission and the members of its advisory committees shall serve without compensation but shall be reimbursed for actual and necessary expenses incurred in the performance of their duties, from the appropriation made by s. 20.315 (1) (q), on vouchers approved by the Wisconsin member of the commission selected to serve as its chairperson or vice chairperson. All other expenses incurred by the commission in the course of exercising its powers and duties, unless met in some other manner specifically provided by statute, shall be paid by the commission out of its own funds.

AB100-ASA1, s. 22 Section 22. 14.90 (2) of the statutes is amended to read:

AB100-ASA1,23,2 14.90 (2) The members of the commission shall serve without compensation but shall be reimbursed from the appropriation under s. 20.505 (3) (be) (a) for actual and necessary expenses incurred in the performance of their duties. The commission has the powers and duties granted and imposed under s. 39.80.

AB100-ASA1, s. 23 Section 23. 14.90 (3) of the statutes is amended to read:

AB100-ASA1,23,6 14.90 (3) From the appropriation under s. 20.505 (3) (be) (a), the department of administration shall pay the costs of membership in and costs associated with the midwestern higher education compact.

AB100-ASA1, s. 24 Section 24. Subchapter VI of chapter 14 [precedes 14.91] of the statutes is repealed.

AB100-ASA1, s. 25 Section 25. 15.01 (2) of the statutes is amended to read:

AB100-ASA1,23,19 15.01 (2) "Commission" means a 3-member governing body in charge of a department or independent agency or of a division or other subunit within a department, except for the education commission which shall consist of 11 members, the Wisconsin waterways commission which shall consist of 5 members, the parole commission which shall consist of 5 members and the Fox river management commission which shall consist of 7 members. A Wisconsin group created for participation in a continuing interstate body, or the interstate body itself, shall be known as a "commission", but is not a commission for purposes of s. 15.06. The parole commission created under s. 15.145 (1) shall be known as a "commission", but is not a commission for purposes of s. 15.06.

AB100-ASA1, s. 26 Section 26. 15.01 (6) of the statutes is amended to read:

AB100-ASA1,24,6 15.01 (6) "Division," "bureau," "section" and "unit" means the subunits of a department or an independent agency, whether specifically created by law or created by the head of the department or the independent agency for the more economic and efficient administration and operation of the programs assigned to the department or independent agency. The office of justice assistance in the department of administration and the office of credit unions in the department of financial institutions have the meaning of "division" under this subsection. The office of health care information in the office of the commissioner of insurance, the office of the long-term care ombudsman under the board on aging and long-term care and the office of educational accountability in the department of education public instruction have the meaning of "bureau" under this subsection.

AB100-ASA1, s. 27 Section 27. 15.02 (1) of the statutes is amended to read:

AB100-ASA1,24,10 15.02 (1) Separate constitutional offices. The governor, lieutenant governor, secretary of state, state superintendent of public instruction and state treasurer each head a staff to be termed the "office" of the respective constitutional officer.

AB100-ASA1, s. 28 Section 28. 15.02 (3) (c) 2. of the statutes is amended to read:

AB100-ASA1,24,17 15.02 (3) (c) 2. The principal subunit of the division is the "bureau". Each bureau shall be headed by a "director". The office of health care information in the office of the commissioner of insurance, the office of the long-term care ombudsman under the board on aging and long-term care and the office of educational accountability in the department of education public instruction have the meaning of "bureau" under this subdivision.

AB100-ASA1, s. 29 Section 29. 15.06 (1) (a) of the statutes is amended to read:

AB100-ASA1,24,22 15.06 (1) (a) Except as otherwise provided in this subsection and s. 15.37, the members of commissions shall be nominated by the governor, and with the advice and consent of the senate appointed, for staggered 6-year terms expiring on March 1 of the odd-numbered years.

AB100-ASA1, s. 30 Section 30. 15.06 (2) (c) of the statutes is repealed.

AB100-ASA1, s. 31 Section 31. 15.06 (3) (a) 6. of the statutes is repealed.

AB100-ASA1, s. 32 Section 32. 15.06 (4) of the statutes is amended to read:

AB100-ASA1,25,4 15.06 (4) Chairperson; administrative duties. The administrative duties of each commission, other than the education commission, shall be vested in its chairperson, to be administered by the chairperson under the statutes and rules of the commission and subject to the policies established by the commission.

AB100-ASA1, s. 33 Section 33. 15.06 (5) of the statutes is amended to read:

AB100-ASA1,25,10 15.06 (5) Frequency of meetings; place. Every commission shall meet on the call of the chairperson or a majority of its members, except that the education commission shall meet on the call of the chairperson or a majority of its voting members. Every commission shall maintain its offices in Madison, but may meet or hold hearings at such other locations as will best serve the citizens of this state.

AB100-ASA1, s. 34 Section 34. 15.06 (6) of the statutes is amended to read:

AB100-ASA1,25,16 15.06 (6) Quorum. A majority of the membership of a commission constitutes a quorum to do business, except that a majority of the voting members of the education commission constitutes a quorum to do business and except that vacancies shall not prevent a commission from doing business. This subsection does not apply to the parole commission.

AB100-ASA1, s. 35 Section 35. 15.07 (1) (a) 1. of the statutes is created to read:

AB100-ASA1,25,19 15.07 (1) (a) 1. Members of the higher educational aids board shall be appointed by the governor without senate confirmation.

AB100-ASA1, s. 36 Section 36. 15.07 (1) (b) 16. of the statutes is repealed.

AB100-ASA1, s. 44d Section 44d. 15.07 (1) (b) 19. of the statutes is repealed.

AB100-ASA1, s. 37 Section 37. 15.07 (1) (cm) of the statutes is amended to read:

AB100-ASA1,26,17 15.07 (1) (cm) The term of one member of the ethics board shall expire on each May 1. The terms of 3 members of the development finance board appointed under s. 15.155 (1) (a) 6. shall expire on May 1 of every even-numbered year and the terms of the other 3 members appointed under s. 15.155 (1) (a) 6. shall expire on May 1 of every odd-numbered year. The terms of the 3 members of the land and water conservation board appointed under s. 15.135 (4) (b) 2. shall expire on January 1. The term of the member of the land and water conservation board appointed under s. 15.135 (4) (b) 2m. shall expire on May 1 of an even-numbered year. The terms of members of the real estate board shall expire on July 1. The terms of the appraiser members of the real estate appraisers board and the terms of the auctioneer and auction company representative members of the auctioneer board shall expire on May 1 in an even-numbered year. The terms of the 4 members of the educational technology board appointed under s. 15.105 (26) (a) 1., 3., 6. and 9. shall expire on May 1 in an even-numbered year. The terms of the members of the public intervenor board shall expire as provided in s. 15.345 (4) (b). The terms of 3 members of the gaming board appointed under s. 15.64 shall expire on July 1 of an even-numbered year and the terms of the other 2 members shall expire on July 1 of an odd-numbered year. The terms of 4 of the members of the state emergency response board, except the administrator of the division of emergency management in the department of military affairs, shall expire on May 1 of each year.

AB100-ASA1, s. 45m Section 45m. 15.07 (1) (cm) of the statutes, as affected by 1997 Wisconsin Act .... (this act), is amended to read:

AB100-ASA1,27,10 15.07 (1) (cm) The term of one member of the ethics board shall expire on each May 1. The terms of 3 members of the development finance board appointed under s. 15.155 (1) (a) 6. shall expire on May 1 of every even-numbered year and the terms of the other 3 members appointed under s. 15.155 (1) (a) 6. shall expire on May 1 of every odd-numbered year. The terms of the 3 members of the land and water conservation board appointed under s. 15.135 (4) (b) 2. shall expire on January 1. AB100-ASA1, s. 38 Section 38. 15.07 (2) (f) of the statutes is amended to read:

AB100-ASA1, s. 39 Section 39. 15.07 (5) (i) of the statutes is created to read:

AB100-ASA1,27,16 15.07 (5) (i) Members of the educational approval board, $25 per day.

AB100-ASA1, s. 40 Section 40. 15.103 (1m) of the statutes is created to read:

AB100-ASA1,27,19 15.103 (1m) Division of gaming. There is created in the department of administration a division of gaming.

AB100-ASA1, s. 41 Section 41. 15.105 (16) of the statutes is repealed.

AB100-ASA1, s. 42 Section 42. 15.105 (25) of the statutes is created to read:

AB100-ASA1,28,2 15.105 (25) Technology for educational achievement in Wisconsin board. There is created a technology for educational achievement in Wisconsin board which is attached to the department of administration under s. 15.03. The board shall consist of the state superintendent of public instruction, the secretary of administration, and the following members appointed for 4-year terms:

AB100-ASA1,28,5 (a) A member of the board of regents of the University of Wisconsin System, appointed by the president of the board of regents of the University of Wisconsin System.

AB100-ASA1,28,7 (b) A member of the technical college system board, appointed by the president of the technical college system board.

AB100-ASA1,28,9 (bm) A member of the educational communications board appointed by the chairperson of the educational communications board.
