ASSEMBLY AMENDMENT 1, TO 1997 ASSEMBLY BILL 197

AB197-AA1,1,1 At the locations indicated, amend the bill as follows:

AB197-AA1,1,3 1. Page 1, line 2: after "tires" insert ", waste tire reimbursement payments and making an appropriation".

AB197-AA1,1,4 2. Page 1, line 3: before that line insert:

AB197-AA1,1,5 " Section 1d. 20.370 (2) (da) of the statutes is created to read:

AB197-AA1,1,10 20.370 (2) (da) Waste tire removal and recovery programs; program activities. A sum sufficient, not to exceed the amount lapsed from the appropriation account under s. 20.370 (2) (dj), 1995 stats., on June 30, 1997, for waste tire grant payments under 1997 Wisconsin Act .... (this act), section 2e and tire dump nuisance abatement under s. 289.55.

AB197-AA1, s. 1e Section 1e. 20.370 (2) (da) of the statutes, as created by 1997 Wisconsin Act .... (this act), is repealed.".

AB197-AA1,1,13 3. Page 1, line 3: delete " Section 1" and substitute "Section 1m".

AB197-AA1,2,1 4. Page 2, line 13: after that line insert:

AB197-AA1,2,2 " Section 2e. Nonstatutory provisions.

AB197-AA1,2,9 (1) During the 1997-99 fiscal biennium, from the appropriation under section 20.370 (2) (da) of the statutes, as created by this act, the department of natural resources shall make a payment to each person who received a waste tire reimbursement grant under sections NR 555.08 to 555.12, Wisconsin Administrative Code, for waste tires used during 1995 if the grant was prorated. The payment may not exceed the amount by which the grant was reduced because it was prorated. The total amount of the payments under this section may not exceed $1,135,700.

AB197-AA1,2,16 (2) If funds are available for expenditure during the 1997-99 fiscal biennium from the appropriation under section 20.370 (2) (da) of the statutes, as created by this act, after making the payments under subsection (1), the department shall expend funds from that appropriation for nuisance abatement under section 289.55 of the statutes at tire dumps, as defined in section 289.55 (1) (b) of the statutes, as affected by this act, that contain solid waste resulting from manufacturing tires. The department may not expend more than $400,000 for this purpose.

AB197-AA1,2,22 (3) If funds are available for expenditure during the 1997-99 fiscal biennium from the appropriation under section 20.370 (2) (da) of the statutes, as created by this act, after funding the nuisance abatement under subsection (2), the department may expend the funds for nuisance abatement under section 289.55 of the statutes at tire dumps, as defined in section 289.55 (1) (b) of the statutes, as affected by this act, that do not contain solid waste resulting from manufacturing tires.

AB197-AA1, s. 2m Section 2m. Effective dates. This act takes effect on the day after publication, except as follows:

AB197-AA1,3,2 (1)  The creation of section 20.370 (2) (da) of the statutes takes effect on July 1, 1997.

AB197-AA1,3,4 (2) The repeal of section 20.370 (2) (da) of the statutes takes effect on June 30, 1998.".
