ASSEMBLY AMENDMENT 8, TO 1997 ASSEMBLY BILL 342

AB342-AA8,1,1 At the locations indicated, amend the bill as follows:

AB342-AA8,1,2 1. Page 2, line 6: after "authority" insert ", making appropriations".

AB342-AA8,1,3 2. Page 5, line 8: after that line insert:

AB342-AA8,1,4 " Section 1g. 20.455 (5) (c) of the statutes is amended to read:

AB342-AA8,1,7 20.455 (5) (c) Reimbursement for victim and witness services. The amounts in the schedule A sum sufficient to provide reimbursement to counties under s. 950.06 (2), if the amount appropriated under par. (g) is insufficient.

AB342-AA8, s. 1h Section 1h. 20.455 (5) (d) of the statutes is created to read:

AB342-AA8,1,12 20.455 (5) (d) Reimbursement for costs of defending victims' rights complaints. A sum sufficient to provide reimbursement under s. 950.095 to persons who are the subject of complaints concerning victims' rights violations, if the amount appropriated under par. (g) is insufficient.".

AB342-AA8,1,13 3. Page 28, line 10: delete "not more than".

AB342-AA8,2,3 4. Page 28, line 13: delete lines 13 and 14 and substitute "of the costs incurred in providing services under s. 950.05. The department shall determine the level of services for which a county may be reimbursed. The county".

AB342-AA8,2,4 5. Page 33, line 12: after that line insert:

AB342-AA8,2,5 " Section 83m. 950.095 of the statutes is created to read:

AB342-AA8,2,12 950.095 Reimbursement for costs of responding to complaints. (1) If a city, village, town or county pays any of the costs incurred in responding to a complaint made under s. 950.08 (3) or 950.09 (2) regarding the treatment of a crime victim by an official, employe or agency of the city, village, town or county, the city, village, town or county shall receive reimbursement from the state for all of the actual costs that it incurred if it files a claim for reimbursement with the department as provided in the rules promulgated under sub. (4).

AB342-AA8,2,18 (2) If an individual who is the subject of a complaint made under s. 950.08 (3) or 950.09 (2) regarding the treatment of a crime victim personally pays any of the costs incurred in responding to the complaint, the individual shall receive reimbursement from the state for all of the actual costs that he or she incurred if he or she files a claim for reimbursement with the department as provided in the rules promulgated under sub. (4).

AB342-AA8,2,21 (3) The department shall reimburse a city, village, town, county or individual for claims made under this section from the appropriations under s. 20.455 (5) (d) and (g).

AB342-AA8,2,23 (4) The department shall promulgate rules for processing claims made under this section.".
