SB373-SSA1,1,2 1An Act to create 23.0945 of the statutes; relating to: a bluff protection program
2and granting rule-making authority.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB373-SSA1, s. 1 3Section 1. 23.0945 of the statutes is created to read:
SB373-SSA1,1,5 423.0945 Bluff protection program. (1) In this section, "municipality"
5means a city, village, town or county.
SB373-SSA1,1,7 6(2) The department may establish a program for bluff protection. If the
7department establishes the program, the department shall do all of the following:
SB373-SSA1,1,88 (a) By rule, define "bluff" for purposes of the program.
SB373-SSA1,1,119 (b) Study natural forces that cause erosion, recession or destruction of bluffs
10and identify bluffs where those natural forces threaten public or private property or
11limit the potential for development of public or private property.

1(c) Study the attributes of bluffs, including biological diversity, recreational
2potential and aesthetic values, that warrant special protection and identify bluffs
3that exhibit those attributes.
SB373-SSA1,2,54 (d) Study the factors that lead to the loss of aesthetic values of bluffs and
5identify bluffs where those factors threaten the loss of aesthetic values.
SB373-SSA1,2,106 (e) Provide information to municipalities and the public regarding the location
7of bluffs where erosion, recession or destruction threaten public or private property
8or limit the potential for development of public or private property, where the
9attributes warranting special protection are exhibited or where development or
10other factors threaten the loss of aesthetic values.
SB373-SSA1,2,1511 (f) Assist municipalities in developing programs to direct development away
12from bluffs where erosion, recession or destruction threaten public or private
13property or limit the potential for development of public or private property, where
14attributes warranting special protection are exhibited or where development or
15other factors threaten the loss of aesthetic values.
