SB420-SSA1,35,20 13(4) Any person may make charges that any holder of a license or certificate of
14authorization issued under this chapter has committed an act for which a reprimand
15or limitation, suspension or revocation of registration is authorized under sub. (2).
16Such charges shall be in writing, shall be sworn to by the person making them and
17shall be submitted to the examining board. The examining board may, on its own
18motion, make such charges. All charges, unless dismissed by the examining board
19as unfounded or trivial, shall be heard by the appropriate section of the examining
20board, subject to the rules promulgated under s. 440.03 (1).
SB420-SSA1,35,24 21(5) If, after a hearing under sub. (4), 3 members of a section of the examining
22board vote in favor of sustaining charges specified in sub. (4), the examining board
23shall reprimand the holder of the license or certificate of authorization or limit,
24suspend or revoke the license or certificate.

1(6) The examining board, for reasons the appropriate section of the examining
2board considers sufficient, may reissue a license or certificate of record to any person
3whose certificate has been revoked if 3 members of the section vote in favor of the
4reissuance. Subject to the rules of the examining board, the examining board may,
5upon payment of the required fee, issue a new license or certificate of authorization
6to replace any license or certificate that is revoked, lost, destroyed or mutilated.
SB420-SSA1,36,11 7470.09 Penalties. (1) A person who violates this chapter or any rule
8promulgated under this chapter may be required to forfeit not more than $5,000 for
9the first offense and may be required to forfeit not more than $10,000 for the 2nd or
10any later offense within a year. Each day of continued violation constitutes a
11separate offense.
SB420-SSA1,36,13 12(2) A person who wilfully violates this chapter or any rule promulgated under
13this chapter may be fined not more than $10,000.
SB420-SSA1, s. 63 14Section 63. 703.11 (2) (b) of the statutes is amended to read:

16with minimum standards for property surveys adopted by the examining board of
17architects, landscape architects, professional geologists, professional engineers,
18designers and land surveyors and showing the location of any unit or building located

SB420-SSA1,36,2121 (1) Definitions. In this section:
SB420-SSA1,36,2322 (a) "Professional geologist section" means the professional geologist section of
23the examining board of professional geologists, hydrologists and soil scientists.

1(b) "Professional hydrologist section" means the professional hydrologist
2section of the examining board of professional geologists, hydrologists and soil
3scientists.
SB420-SSA1,37,64 (c) "Professional soil scientist section" means the professional soil scientist
5section of the examining board of professional geologists, hydrologists and soil
6scientists.
SB420-SSA1,37,117 (2) Initial appointments. Notwithstanding the length of terms specified in
8section 15.405 (2m) (a) (intro.) of the statutes, as created by this act, the initial
9members of the examining board of professional geologists, hydrologists and soil
10scientists shall be appointed by the first day of the 4th month beginning after the
11effective date of this subsection for the following terms:
SB420-SSA1,37,1312 (a) One professional geologist, one professional hydrologist and one
13professional soil scientist, for terms expiring on July 1, 2000.
SB420-SSA1,37,1514 (b) One professional geologist, one professional hydrologist, one professional
15soil scientist and one public member, for terms expiring on July 1, 2001.
SB420-SSA1,37,1716 (c) One professional geologist, one professional hydrologist, one professional
17soil scientist and one public member, for terms expiring on July 1, 2002.
SB420-SSA1,37,1818 (d) One public member, for a term expiring on July 1, 2003.
SB420-SSA1,37,1919 (3) Transitional provisions.
SB420-SSA1,37,2120 (a) Notwithstanding section 470.04 of the statutes, as created by this act, the
21professional geologist, hydrologist or soil scientist section shall do all of the following:
SB420-SSA1,38,2 221. Issue a professional geologist license to an individual who holds a valid
23certificate of registration as a professional geologist by the examining board of
24architects, landscape architects, professional geologists, professional engineers,

1designers and land surveyors under section 443.10 (2) (c), 1995 stats., that was
2granted before the effective date of this subdivision.
SB420-SSA1,38,5 32. Issue a professional hydrologist license or a professional soil scientist license
4to an individual who, subject to sections 111.321, 111.322 and 111.335 of the statutes,
5does not have an arrest or conviction record, and who does all of the following:
SB420-SSA1,38,8 6a. Submits an application for the license to the department of regulation and
7licensing no later than the first day of the 6th month beginning after the effective
8date of this subdivision 2. a.
SB420-SSA1,38,9 9b. Pays the fee specified in section 440.05 (1) of the statutes.
SB420-SSA1,38,13 10c. Submits evidence satisfactory to the professional hydrologist or soil scientist
11section that he or she has a bachelor's degree, and at least 30 semester hours or 45
12quarter hours of course credits related to hydrology, water resources or soil science,
13from a college or university approved by the section.
SB420-SSA1,38,25 14d. Submits evidence satisfactory to the professional hydrologist or soil scientist
15section that, after completing the educational requirements specified in subdivision
162. c ., the individual has completed at least 5 years of professional experience in
17hydrologic or soil science work of a character satisfactory to the section that
18demonstrates that the applicant is qualified to assume responsible charge of
19hydrologic or soil science work. At least 2 years of the hydrologic or soil science work
20required under this subdivision 2. d. must have been performed under the
21supervision of a person whom the section determines is qualified to have responsible
22charge of hydrologic or soil science work. The 5 year's experience requirement in this
23subdivision 2. d. shall be reduced to 4 years if the individual has one or more
24advanced degrees, approved by the section, in hydrology or soil science or a geological
25science that is related to hydrology or soil science.

1e. Submits to the section letters of recommendation from 5 persons. At least
23 letters shall be from individuals who have personal knowledge of the experience
3in hydrologic or soil science work of the individual applying for licensure.
SB420-SSA1,39,84 (b) Notwithstanding section 470.045 (2) and (3) of the statutes, as created by
5this act, the professional geologist section shall issue a professional geology firm,
6partnership or corporation certificate of authorization to a firm, partnership or
7corporation that was granted a certificate of authorization under section 443.08 (3)
8(a), 1995 stats., by the section before the effective date of this paragraph.
SB420-SSA1,39,179 (c) A license issued under paragraph (a) shall have the same force and effect
10as a professional geologist, hydrologist or soil scientist license that is issued under
11section 470.04 of the statutes, as created by this act, and may be renewed under
12section 470.07 of the statutes, as created by this act. A professional geology firm,
13partnership or corporation certificate of authorization issued under paragraph (b)
14shall have the same force and effect as a certificate of authorization issued by the
15professional geologist section under section 470.045 (3) (a) of the statutes, as created
16by this act, and may be renewed under section 470.045 (3) (b) of the statutes, as
17created by this act.
SB420-SSA1,40,218 (4) Emergency rules. Using the procedure under section 227.24 of the
19statutes, the examining board of professional geologists, hydrologists and soil
20scientists may promulgate rules required under section 470.03 (1) (a), (b) and (c) of
21the statutes, as created by this act, for the period before the effective date of
22permanent rules promulgated under section 470.03 (1) (a), (b) and (c) of the statutes,
23as created by this act, but not to exceed the period authorized under section 227.24
24(1) (c) and (2) of the statutes. Notwithstanding section 227.24 (1) (a) and (2) (b) of the
25statutes, the examining board of professional geologists, hydrologists and soil

1scientists need not provide evidence of the necessity of preservation of the public
2peace, health, safety or welfare in promulgating rules under this subsection.
SB420-SSA1,40,103 (5) Transfer of authority and records between examining boards. During the
4period beginning on the effective date of this subsection and ending on the first day
5of the 6th month beginning after the effective date of this subsection, the examining
6board of architects, landscape architects, professional geologists, professional
7engineers, designers and land surveyors shall cooperate with the professional
8geologist, hydrologist and soil scientist sections in providing orderly and efficient
9transfers under this subsection. On the first day of the 6th month beginning after
10the effective date of this subsection, all of the following apply:
SB420-SSA1,40,1511 (a) The assets and liabilities of the examining board of architects, landscape
12architects, professional geologists, professional engineers, designers and land
13surveyors pertaining to the regulation of professional geologists, hydrologists or soil
14scientists shall become the assets and liabilities of the examining board of
15professional geologists, hydrologists and soil scientists.
SB420-SSA1,40,2016 (b) All tangible personal property, including records, of the examining board of
17architects, landscape architects, professional geologists, professional engineers,
18designers and land surveyors pertaining to the regulation of professional geologists,
19hydrologists or soil scientists is transferred to the examining board of professional
20geologists, hydrologists and soil scientists.
SB420-SSA1,41,921 (c) All rules pertaining to the regulation of professional geologists, hydrologists
22or soil scientists that have been promulgated by the examining board of architects,
23landscape architects, professional geologists, professional engineers, designers and
24land surveyors and that are in effect shall become rules of the examining board of
25professional geologists, hydrologists and soil scientists and shall remain in effect

1until their specified expiration dates or until amended or repealed by the examining
2board of professional geologists, hydrologists and soil scientists. All orders
3pertaining to the regulation of professional geologists, hydrologists or soil scientists
4that have been issued by the examining board of architects, landscape architects,
5professional geologists, professional engineers, designers and land surveyors and
6that are in effect shall become orders of the examining board of professional
7geologists, hydrologists and soil scientists and shall remain in effect until their
8specified expiration dates or until modified or rescinded by the examining board of
9professional geologists, hydrologists and soil scientists.
SB420-SSA1,41,1810 (d) Any matter relating to the regulation of professional geologists,
11hydrologists or soil scientists that is pending with the examining board of architects,
12landscape architects, professional geologists, professional engineers, designers and
13land surveyors is transferred to the examining board of professional geologists,
14hydrologists and soil scientists, and all materials submitted to or actions taken by
15the examining board of architects, landscape architects, professional geologists,
16professional engineers, designers and land surveyors with respect to the pending
17matter are considered to have been submitted to or taken by the examining board of
18professional geologists, hydrologists and soil scientists.
SB420-SSA1, s. 65 19Section 65. Effective dates. This act takes effect on January 1, 1999, except
20as follows:
