17American Indian tribe or band in this state.
AB133-ASA1,1380,1818 (b) "Professional services" has the meaning given in s. 560.17 (1) (c).
AB133-ASA1,1380,2019 (c) "Qualified business" means an existing business, including a Native
20American business, that is located in this state.
AB133-ASA1,1380,22 21(2) Subject to subs. (3), (4) and (5), from the appropriations under s. 20.143 (1)
22(ig) and (kj), the department may do all of the following:
AB133-ASA1,1380,2423 (a) Make a grant that does not exceed $15,000 to a qualified business for
24professional services.

1(b) Make a grant or loan that does not exceed $100,000 to a qualified business
2for fixed asset financing.
AB133-ASA1,1381,4 3(3) The department may not make a grant or loan to a qualified business under
4this section unless the department determines all of the following:
AB133-ASA1,1381,65 (a) That the qualified business has been negatively impacted by the existence
6of a casino.
AB133-ASA1,1381,87 (b) That the qualified business has a legitimate need for the grant or loan to
8improve the profitability of the business.
AB133-ASA1,1381,13 9(4) As a condition of approval of a grant or loan under this section, the
10department shall require that the qualified business provide matching funds for at
11least 25% of the cost of the project. The department may waive the requirement
12under this subsection if the department determines that the qualified business is
13subject to extreme financial hardship.
AB133-ASA1,1381,16 14(5) The department may not award a grant or loan under this section to a
15qualified business for any purpose that is related to tourism unless the department
16of tourism concurs in the award.
AB133-ASA1,1381,18 17(6) (a) The department shall deposit into the appropriation account under s.
1820.143 (1) (ig) all moneys received in repayment of loans made under this section.
AB133-ASA1,1381,2019 (b) The department may forgive all or any part of a loan made under this
20section.
AB133-ASA1, s. 2953 21Section 2953. 560.138 of the statutes is created to read:
AB133-ASA1,1381,22 22560.138 Gaming economic diversification grants and loans. (1) In this
AB133-ASA1,1381,2323 section:
AB133-ASA1,1382,224 (a) "Native American business" means a sole proprietorship, partnership,
25limited liability company, joint venture or corporation that is at least 51% owned,

6(id) and (km), the department may make a grant or loan to a qualified business for
7a project for the purpose of diversifying the economy of a community.
AB133-ASA1,1382,98 (b) In determining whether to award a grant or loan under this section, the
9department shall consider all of the following:
AB133-ASA1,1382,1010 1. A project's potential to retain or increase the number of jobs.
AB133-ASA1,1382,1111 2. A project's potential to provide for significant capital investment.
AB133-ASA1,1382,1212 3. A project's contribution to the economy of the community.
AB133-ASA1,1382,15 13(3) As a condition of approval of a grant or loan under this section, the
14department shall require that a qualified business provide matching funds for at
15least 25% of the cost of a project.
AB133-ASA1,1382,18 16(4) The department may not award a grant or loan under this section to a
17qualified business for any purpose that is related to tourism unless the department

23redevelopment.
(a) Subject to par. (b), from the appropriation under s. 20.143 (1)
24(kj), the department shall make grants annually to the city of Milwaukee to fund a
25program to be administered by the Milwaukee Economic Development Corporation.

1Under the program, the Milwaukee Economic Development Corporation shall
2provide grants to persons for remediation and economic redevelopment projects in
3the Menomonee valley. A person may not receive a grant unless the person provides
4matching funds for at least 50% of the cost of the project.
AB133-ASA1,1383,65 (b) The department may not expend more than $1,000,000 in grants to the city
6of Milwaukee under this subsection annually.
AB133-ASA1,1383,13 7(2) Community-based venture fund. (a) From the appropriation under s.
820.143 (1) (kj), the department shall make grants to the Northwest Regional
9Planning Commission to match federal or private funds for the purpose of
10establishing a community-based venture fund. Subject to par. (b), the department
11shall provide grants each year in an amount that equals 50% of the total amount that
12the Northwest Regional Planning Commission receives in the year from federal or
13private sources for the community-based venture fund.

15subsection annually.

AB133-ASA1,1385,76 3. The rural municipality in which the business is or will be located satisfies
7either of the following criteria:
AB133-ASA1,1385,98 a. The rural municipality is located in a county that has a median household
9income that is lower than the state median household income.
AB133-ASA1,1385,1310 b. If the rural municipality is located in a county that has a median household
11income that is higher than the state median household income, the rural
12municipality has a median household income that is lower than the county median
13household income.
AB133-ASA1,1385,1414 4. The business is starting or expanding its operations.
AB133-ASA1,1385,1515 5. The operations of the business do not involve metallic mining activities.
AB133-ASA1,1385,1816 6. The owner of the business attends a class that provides instruction in writing
17a business plan, making a business loan application and managing a start-up
18business.
AB133-ASA1,1385,2319 (b) A business applying for a loan under this subsection must submit an
20application package that includes a business plan and such personal and business
21financial information as the board requires to enable the board to assess sufficiently
22the potential viability of the business. The department shall assist a business in
23preparing an application.
AB133-ASA1,1385,2524 (c) A business that receives a loan under this subsection may use the loan
25proceeds for any of the following purposes:

11. The purchase or improvement of land.
AB133-ASA1,1386,32 2. The purchase of buildings, furniture, fixtures, machinery, equipment or
3inventory.
AB133-ASA1,1386,44 3. Job training costs.
AB133-ASA1,1386,55 4. Employe relocation costs.
AB133-ASA1,1386,66 5. Working capital.
AB133-ASA1,1386,97 (d) If a business that receives a loan under this subsection uses the loan
8proceeds for employe relocation costs under par. (c) 4., the department shall ensure
9all of the following:
AB133-ASA1,1386,1110 1. That an employe of the business has the option of accepting or declining any
11relocation assistance that is available as a result of the loan.
AB133-ASA1,1386,1312 2. That the compensation and benefits terms offered at the new location are at
13least as favorable as those offered by the business at its previous location.
AB133-ASA1, s. 2955p 14Section 2955p. 560.17 (6m) of the statutes is renumbered 560.17 (6m) (a) and

24contribution may be in cash or in kind. The board shall determine what services or
25materials may be used as in-kind contributions.
