ASSEMBLY SUBSTITUTE AMENDMENT 1, TO 1999 ASSEMBLY BILL 238

AB238-ASA1,1,2 An Act to create 346.705 and 346.74 (6) of the statutes; relating to: the consumption of alcohol after a traffic accident and providing a penalty.

The people of the state of Wisconsin, represented in senate and assembly, do enact as follows:

AB238-ASA1, s. 1 Section 1. 346.705 of the statutes is created to read:

AB238-ASA1,1,6 346.705 Consumption of alcohol after an accident prohibited. The operator of a motor vehicle who was involved in an accident that is reportable under s. 346.70 (1) may not consume alcohol within 3 hours after that accident.

AB238-ASA1, s. 2 Section 2. 346.74 (6) of the statutes is created to read:

AB238-ASA1,1,9 346.74 (6) Any person violating s. 346.705 shall be fined not more than $1,000 or imprisoned for not more than 90 days or both.

AB238-ASA1, s. 3 Section 3. Initial applicability.

AB238-ASA1,1,12 (1) This act first applies to accidents occurring on the effective date of this subsection.

AB238-ASA1, s. 4 Section 4. Effective date.

AB238-ASA1,2,3 (1) This act takes effect on the first day of the 3rd month beginning after publication.
