ASSEMBLY AMENDMENT 3, TO 1999 ASSEMBLY BILL 614

AB614-AA3,1,1 At the locations indicated, amend the bill as follows:

AB614-AA3,1,2 1. Page 5, line 16: delete lines 16 to 21 and substitute:

AB614-AA3,1,5 "1. If the person transfers sounds into or onto recordings or advertises, offers for sale or rent, sells, rents, possesses or transports recordings in violation of sub. (1) and the value of the recordings does not exceed $2,500.

AB614-AA3,1,7 2. If the person transfers sounds on or to the Internet in violation of sub. (1) and the value of the transferred sounds does not exceed $2,500.".

AB614-AA3,1,8 2. Page 5, line 22: delete "Class D" and substitute "Class E".

AB614-AA3,1,10 3. Page 5, line 24: delete the material beginning with that line and ending with page 6, line 14, and substitute:

AB614-AA3,1,13 "1. If the person transfers sounds into or onto recordings or advertises, offers for sale or rent, sells, rents, possesses or transports recordings in violation of sub. (1) and the value of the recordings exceeds $2,500.

AB614-AA3,2,3 4. Page 7, line 5: delete lines 5 to 19 and substitute:

AB614-AA3,2,7 "(2) (a) Whoever violates sub. (1) is guilty of a Class A misdemeanor if the person creates, advertises, offers for sale or rent, sells, rents, transports or possesses recordings embodying sound or audiovisual recordings in violation of sub. (1) and the value of the recordings does not exceed $2,500.

(1) is guilty of a Class E felony if the person creates, advertises, offers for sale or rent, sells, rents, transports or possesses recordings embodying sound or audiovisual recordings in violation of sub. (1) and the value of the recordings exceeds $2,500.".

AB614-AA3,2,12 5. Page 8, line 7: delete lines 7 to 18 and substitute:

AB614-AA3,2,16 "(2) (a) Whoever violates sub. (1) is guilty of a Class A misdemeanor if the person advertises, offers for sale or rent, sells, rents, transports or possesses recordings in violation of sub. (1) and the value of the recordings does not exceed $2,500.

AB614-AA3,2,19 (b) Whoever violates sub. (1) is guilty of a Class E felony if the person advertises, offers for sale or rent, sells, rents, transports or possesses recordings in violation of sub. (1) and the value of the recordings exceeds $2,500.".

AB614-AA3,2,21 "(b) Whoever violates par. (a) is guilty of a Class A misdemeanor.".

AB614-AA3,2,23 7. Page 9, line 20: delete the material beginning with that line and ending with page 10, line 23, and substitute:

AB614-AA3,3,2 "(b) 1. Whoever violates par. (a) is guilty of a Class A misdemeanor under any of the following circumstances:

AB614-AA3,3,5 a. If the person creates, advertises, offers for sale or rent, sells, rents, transports or possesses recordings in violation of par. (a) and the value of the recordings does not exceed $2,500.

AB614-AA3,3,7 b. If the person transfers sounds on or to the Internet in violation of par. (a) and the value of the transferred sounds does not exceed $2,500.

AB614-AA3,3,9 2. Whoever violates par. (a) is guilty of a Class E felony under any of the following circumstances:

AB614-AA3,3,12 a. If the person creates, advertises, offers for sale or rent, sells, rents, transports or possesses recordings in violation of par. (a) and the value of the recordings exceeds $2,500.

AB614-AA3,3,14 b. If the person transfers sounds on or to the Internet in violation of par. (a) and the value of the transferred sounds exceeds $2,500.".
