SENATE AMENDMENT 1, TO 2001 SENATE BILL 305

SB305-SA1,1,1 At the locations indicated, amend the bill as follows:

SB305-SA1,1,2 1. Page 7, line 5: after that line insert:

SB305-SA1,1,3 " Section 7m. 446.02 (10) of the statutes is repealed.".

SB305-SA1,1,4 2. Page 7, line 9: delete lines 9 to 11 and substitute:

SB305-SA1,1,9 "448.50 (1r) "Diagnosis" means a judgment that is made after examining the neuromusculoskeletal system or evaluating or studying its symptoms and that utilizes the techniques and science of physical therapy for the purpose of establishing a plan of therapeutic intervention, but does not include a chiropractic or medical diagnosis.".

SB305-SA1,2,12 448.50 (4) (b) "Physical therapy" does not include using roentgen rays or radium for any purpose, using electricity for surgical purposes, including cauterization, or prescribing drugs or devices.".

SB305-SA1,2,14 15. Page 10, line 11: after that line insert:

SB305-SA1, s. 19m Section 19m. 448.52 (intro.) of the statutes is renumbered 448.52 (1m) (intro.) and amended to read:

SB305-SA1,2,20 448.52 (1m) (intro.) A license is not required under this subchapter for any of the following, if the person does not claim to render physical therapy or physiotherapy services as prohibited under s. 448.51 (2) (b):

SB305-SA1, s. 19s Section 19s. 448.52 (1) and (2) of the statutes are renumbered 448.52 (1m) (a) and (b).

SB305-SA1, s. 19v Section 19v. 448.52 (2m) of the statutes is created to read:

SB305-SA1,3,2 448.52 (2m) A license is not required under this subchapter for any of the following:

SB305-SA1,3,5 (a) Except as provided in par. (b), a chiropractor licensed under ch. 446 claiming to render physical therapy, if the physical therapy is provided by a physical therapist employed by the chiropractor.

SB305-SA1,3,7 (b) A chiropractor licensed under ch. 446 claiming to render modality based physical therapy services.".

SB305-SA1,3,8 16. Page 10, line 13: delete that line and substitute:

SB305-SA1,3,10 " Section 21b. 448.52 (4) of the statutes is renumbered 448.52 (1m) (c) and amended to read:".

SB305-SA1,3,11 17. Page 10, line 14: delete "448.52 (4)" and substitute "448.52 (1m) (c)".

SB305-SA1,3,12 18. Page 10, line 17: after that line insert:

SB305-SA1,3,13 " Section 21m. 448.52 (5) of the statutes is renumbered 448.52 (1m) (d).

SB305-SA1, s. 21p Section 21p. 448.522 of the statutes is created to read:

SB305-SA1,3,17 448.522 Manipulation services. A physical therapist may not claim that any manipulation service that he or she provides is in any manner a chiropractic adjustment that is employed to correct a chiropractic spinal subluxation.

SB305-SA1, s. 21t Section 21t. 448.525 of the statutes is repealed.".

SB305-SA1,3,20 19. Page 13, line 24: delete the material beginning with that line and ending with page 14, line 4.
