9later than June 30, 2003.".

(3wy) Highway rest areas. The total amount of any proposed expenditures or
12encumbrances that the department of transportation does not make in the 2001-03
13fiscal biennium as a result of the implementation of section 84.04 (4) of the statutes,

152001-03 fiscal biennium to reopen previously closed rest areas or to keep open rest
16areas that are proposed for closure in areas where other rest areas and motorist
17services described in section 86.195 (3) of the statutes are not available.".

(4k) Sparta overpass. In the 2001-03 fiscal biennium, from the appropriation
20under section 20.395 (2) (nx) of the statutes, the department of transportation shall
21award a grant of $496,000 to the city of Sparta in Monroe County for construction
22of a snowmobile-bicycle-pedestrian overpass over I 90 in the city of Sparta. The
23overpass shall be at least 14 feet in width and shall be located to provide convenient
1and safe access to the Elroy-Sparta State Trail, the La Crosse River State Trail, and
2nearby snowmobile trails.".

(4e) Capitol Court project. Of the amounts appropriated to the department
5of transportation under section 20.395 (3) (cq) of the statutes, as affected by this act,
6on the effective date of this subsection, the department shall allocate $250,000 for
7preliminary engineering for and construction, reconstruction, or improvement of
8highways, transportation facilities, or other functionally related or auxiliary
9facilities or structures associated with the Capitol Court project on West Capitol
10Drive in the city of Milwaukee and for associated economic development.
11Notwithstanding section 20.001 (3) (c) of the statutes, if the department has not
12expended or encumbered any funds for the project on or before June 30, 2003, the
13funds allocated under this subsection shall lapse from the appropriation account
14under section 20.395 (3) (cq) of the statutes, as affected by this act, to the
15transportation fund.".

(4h) Eisner Avenue Pedestrian-Bike Trail project. In the 2001-03 fiscal
18biennium, from the appropriation under section 20.395 (2) (nx) of the statutes, the
19department of transportation shall award a grant under section 85.026 (2) of the
20statutes to the city of Sheboygan in Sheboygan County or the town of Sheboygan in
21Sheboygan County, or both, for the project known as the Eisner Avenue
22Pedestrian-Bike Trail Improvement project, if the recipient of the grant awarded
23under this subsection contributes funds for the project that total at least 20% of the
24costs of the project.".

(4v) Grants to Brown County and municipalities. From the appropriation
3under section 20.395 (2) (iq) of the statutes in fiscal year 2001-02, the department
4of transportation shall award grants under section 84.185 of the statutes, as affected
5by this act, totaling $410,000 in January 2002 to Brown County, the city of Green Bay,
6and the village of Ashwaubenon to be used to pay costs associated with the CTH
7"VK"/Lombardi Avenue project in the city of Green Bay in Brown County. Grant
8proceeds under this subsection shall be distributed in proportion to the percentage
9of the costs of the project to be borne by each local governmental unit. The provisions
10of section 84.185 of the statutes, as affected by this act, relating to the awarding of
11grants, the amount of grants, and the eligibility requirements for grants, including
12a required local contribution under section 84.185 (2) (b) 5. of the statutes, do not
13apply to grants awarded under this subsection".

(4z) Improvement of 85th Street in Kenosha County. Notwithstanding
17limitations on the amount and use of aids provided under section 86.31 of the
18statutes, as affected by this act, or on eligibility requirements for receiving aids
19under section 86.31 of the statutes, as affected by this act, the department of
20transportation shall award a grant of $609,000 in the 2001-03 fiscal biennium to the
21village of Pleasant Prairie in Kenosha County for improvements to 85th Street in the
22village of Pleasant Prairie. Payment of the grant under this subsection shall be made
23from the appropriation under section 20.395 (2) (fr) of the statutes, as affected by this
24act, before making any other allocation of funds under section 86.31 (3) (b) of the
1statutes, and is in addition to the village of Pleasant Prairie's entitlement, as defined
2in section 86.31 (1) (ar) of the statutes, to aids under section 86.31 of the statutes, as
3affected by this act.".

ighways designated for use by oversize vehicles. Notwithstanding
6section 348.07 (4) of the statutes, the secretary of transportation shall designate the
7following highways to which sections 348.07 (2) (f), (fm), (gm), and (gr) and 348.08
8(1) (e) and (h) of the statutes apply: STH 107 from CTH "A" in Marathon County to
9STH 64 in Lincoln County, CTH "A" from STH 97 to CTH "K" in Marathon County,
10CTH "K" from Wausau in Marathon County to Merrill in Lincoln County, CTH "Q"
11from CTH "K" to USH 51 in Lincoln County, CTH "U" from STH 107 to USH 51 in
12Marathon County, and STH 97 from STH 29 in Marathon County to STH 64 in Taylor
13County. This subsection does not apply after June 30, 2003, or, if the secretary makes
14a determination before June 30, 2003, whether to designate the highways specified
15under this subsection under section Trans 276.07, Wisconsin Administrative Code,
16on the day after such determination.".

(5e) Ashland railroad depot. From the appropriations under section 20.395
19(2) (nx) of the statutes, the department of transportation shall award a grant under

21Ashland to be used to restore the historic Ashland railroad depot, if a person, other
22than the state, contributes funds for the restoration that at least equal 20% of the
23costs of the restoration.".

2quarterly meeting of the joint committee on finance under section 13.10 of the
3statutes in the 2001-02 fiscal year, the department of transportation may submit to

5the appropriation under section 20.395 (3) (cq) of the statutes, as affected by this act,
6to the appropriation under section 20.395 (3) (eq) of the statutes, as affected by this
7act, in the 2002-03 fiscal year for the purpose of funding the installation,
8replacement, rehabilitation, or maintenance of highway signs, traffic control signals,
9highway lighting, pavement markings, and intelligent transportation systems.".

(1d) Renew Wisconsin performance standards. The board of regents of the
13University of Wisconsin System shall direct the University of Wisconsin
14System-Extension to work with the League of Wisconsin Municipalities, the

16Counties Association to provide training on performance standards as provided
17under section 66.0316 (6) (c) of the statutes, as created by this act.".

16shall carry out any contractual obligations under such a contract until the contract
17is modified or rescinded by the department of administration to the extent allowed
18under the contract.

23or repealed by the department of administration. All orders issued by the board of
24regents of the University of Wisconsin System that are primarily related to its
25vehicle fleet maintenance functions at the University of Wisconsin-Madison, and
1that are in effect on the effective date of this paragraph remain in effect until their
2specified expiration dates or until modified or rescinded by the department of
3administration.

4(e) Any matter pending with the board of regents of the University of Wisconsin
5System that is primarily related to its vehicle fleet maintenance functions at the

8actions taken by the board of regents of the University of Wisconsin System with
9respect to the pending matter are considered as having been submitted to or taken
10by the department of administration.

5(b) Notwithstanding section 16.505 (1) of the statutes, as affected by this act,
6before July 1, 2003, the board may create up to 50 authorized FTE positions in the
7classified service of the state civil service system at the University of
8Wisconsin-Madison in positions that are frequently filled by limited term
9appointments, as determined by the board in consultation with the department of
10employment relations. The authorized FTE positions may be GPR positions, PR
11positions, or SEG positions, or any combination thereof.

12(c) Notwithstanding section 230.15 of the statutes, the board may initially
13appoint to the positions created under paragraph (b) only individuals who have held
14limited term appointments at the University of Wisconsin-Madison for at least one
15year. Individuals so appointed are not required to be certified under section 230.25
16of the statutes and are not required to have qualified for the position by competitive
17examination. Any position created under paragraph (b) may not be filled by transfer
18under section 230.29 of the statutes.

19(d) Notwithstanding section 20.928 (1) of the statutes, before July 1, 2003, the
20board may not certify under section 20.928 (1) of the statutes any sum of money
21needed to pay any costs associated with a position created under paragraph (b) if that

23(e) During the 2001-03 fiscal biennium, the board shall report quarterly to the
24department of administration and to the joint committee on finance on the number
25of positions created under paragraph (b).

2governor, the department of employment relations, and to the chief clerk of each
3house of the legislature for distribution to the legislature under section 13.172 (2) of

5shall determine if the number of limited term appointments at the University of
6Wisconsin-Madison has been reduced as a result of the creation of positions under
7paragraph (b); document the number of individuals appointed to positions created
8under paragraph (b) and the number of years of employment that these individuals
9had as limited term appointments at the time of their appointment to the positions
10created under paragraph (b); and examine the reasons why any individual who was
11appointed to a position created under paragraph (b) subsequently terminated
12employment with the board.

13(3e) Fringe benefits for certain limited term appointments. Notwithstanding
14section 230.26 (4) of the statutes, any person who holds a limited term appointment
15under section 230.26 (1) of the statutes at the University of Wisconsin-Madison and
16is a participating employee, as defined in section 40.02 (46) of the statutes, shall
17receive paid vacation and sick leave during the period that begins on the effective
18date of this subsection and ends on June 30, 2003. For the purpose of calculating the
19amount of paid vacation and sick leave to which a person holding a limited term
20appointment is entitled under this subsection, the person shall be considered a
21permanent employee.".
