SENATE AMENDMENT 2, TO 2007 SENATE BILL 380

SB380-SA2,1,1 At the locations indicated, amend the bill as follows:

SB380-SA2,1,2 1. Page 3, line 18: delete "2008" and substitute "2009".

SB380-SA2,1,3 2. Page 3, line 19: delete "2007" and substitute "2008".

SB380-SA2,1,4 3. Page 3, line 23: delete "2009" and substitute "2010".

SB380-SA2,1,5 4. Page 3, line 25: delete "2009" and substitute "2010".

SB380-SA2,1,9 5. Page 5, line 6: after "(a)." insert "The department shall ensure that any system of credit trading under this paragraph is coordinated with any system of credit trading under 42 USC 7545 (o) (5), including using comparable standards for denominating, measuring, verifying, using, and retiring credits.".

SB380-SA2,1,10 6. Page 5, line 6: after that line insert:

SB380-SA2,2,2 "(5m) Warning. The first time that the department determines that a person has violated sub. (2) or (4) (c), the department shall issue a written warning notice to the person. A person who has not been issued a warning under this subsection is not subject to the penalties under sub. (6).".

SB380-SA2,2,4 7. Page 5, line 8: delete "$10,000 for a first offense" and substitute "$5,000 for a first conviction".

SB380-SA2,2,6 8. Page 5, line 10: delete "$50,000 for a 2nd offense" and substitute "$10,000 for a 2nd conviction".

SB380-SA2,2,12 11. Page 5, line 16: delete "$50,000 for a 2nd offense" and substitute "$10,000 for a 2nd conviction".

SB380-SA2,2,15 13. Page 5, line 18: after that line insert:

SB380-SA2,2,21 (1) Biodiesel fuel study. The department of agriculture, trade and consumer protection shall conduct a study of the sale and distribution of biodiesel fuel in this state. No later than January 1, 2010, the department shall report the results of its study to the legislature in the manner provided under section 13.172 (2) of the statutes.".
