SENATE AMENDMENT 13, TO SENATE SUBSTITUTE AMENDMENT 1, TO SENATE BILL 21

SB21-SSA1-SA13,1,1 At the locations indicated, amend the substitute amendment as follows:

SB21-SSA1-SA13,1,6 1. Page 195, line 5: decrease the dollar amount for fiscal year 2015-16 by $30,600 and decrease the dollar amount for fiscal year 2016-17 by $39,300 for the purpose of eliminating the independent assessment requirement for personal care services under the Medical Assistance program and to decrease the authorized FTE positions for the department of health services by 0.5 GPR position.

Page 195, line 7: increase the dollar amount for fiscal year 2015-16 by $3,546,900 and increase the dollar amount for fiscal year 2016-17 by $8,073,100 for the purpose of eliminating the independent assessment requirement for personal care services under the Medical Assistance program.

Page 195, line 7: increase the dollar amount for fiscal year 2015-16 by $4,800,000 and increase the dollar amount for fiscal year 2016-17 by $6,930,000 for the purpose of providing a 4 percent increase in personal care fee-for-service rates in the Medical Assistance program in 2015-16 and a 4 percent increase in personal care fee-for-service rates in the Medical Assistance program in 2016-17.

Page 195, line 7: increase the dollar amount for fiscal year 2015-16 by $8,970,900 and increase the dollar amount for fiscal year 2016-17 by $19,277,200 for the purpose of providing a 1 percent acuity increase to nursing homes in 2015-16 and an additional 1 percent acuity increase in 2016-17 and to reflect the cost of using revenue from the nursing home bed assessment to provide a 2 percent increase to nursing homes in 2015-16 and an additional 2 percent increase in 2016-17.

Before submitting its 2017-19 biennial budget request, the department shall hold at least 6 discussion meetings with consumers and other parties interested in long-term care programs to identify opportunities for improving the family care program, IRIS, and the state's other long-term care programs.".

SB21-SSA1-SA13,3,9 (a) Elimination of independent assessment contract. The department of health services may not require, before a recipient of Medical Assistance benefits receives personal care services on a fee-for-service basis, that an entity that does not oversee, manage, or provide the personal care services conduct an assessment to determine the amount and frequency of services the individual requires.

SB21-SSA1-SA13,3,14 (b) Position reduction. The authorized FTE positions for the department of health services are decreased by 0.5 FED position on July 1, 2015, to be funded from the appropriation under section 20.435 (4) (n) of the statutes, for eliminating the independent assessment requirement for personal care services under the Medical Assistance program.".
