ASSEMBLY AMENDMENT 2, TO ASSEMBLY BILL 317

AB317-AA2,1,1 At the locations indicated, amend the bill as follows:

AB317-AA2,1,2 1. Page 7, line 19: delete “the joint committee for review of".

AB317-AA2,1,3 2. Page 7, line 20: delete “administrative rules for authorization".

AB317-AA2,1,5 3. Page 8, line 1: delete “the joint committee for review of administrative rules".

AB317-AA2,1,6 4. Page 8, line 22: delete lines 22 and 23 and substitute:

AB317-AA2,2,4 “4. If the joint committee for review of administrative rules approves a petition under subd. 3. a., the joint committee shall notify the agency. The joint committee shall also notify the presiding officer of each house of the legislature, who shall, within 10 working days following the day on which the notice is received, direct the appropriate chief clerk to refer the petition to one standing committee. Each standing committee may approve or deny the petition, but if the chairperson of a standing committee does not, within 10 days after receipt of the petition, notify the agency that it has scheduled a meeting for the purpose of reviewing the petition, the petition is considered approved by that committee. The chairperson of a standing committee shall notify the agency of any affirmative action taken under this subdivision to approve or deny a petition.”.

AB317-AA2,2,5 5. Page 8, line 24: delete lines 24 and 25 and substitute:

AB317-AA2,2,7 “(c) If a petition to repeal an unauthorized rule is approved by both standing committees to which it is referred under par. (b) 4., the agency shall”.
