AB115,1,3 1An Act to create 167.31 (4) (a) 4. of the statutes; relating to: the placement,
2possession, transportation, loading or discharge of a firearm by certain private
3security persons.
Analysis by the Legislative Reference Bureau
Current law prohibits, with certain exceptions, a person from doing any of the
following: 1) placing, possessing or transporting a firearm in or on a motorboat, if
the motor is running, or in or on a vehicle, unless the firearm is unloaded; 2) placing,
possessing or transporting a firearm in or on an aircraft, unless the firearm is
unloaded and encased; 3) loading or discharging a firearm in or from a vehicle or
aircraft; and 4) discharging a firearm from or across a highway or within 50 feet of
the center of a roadway. These prohibitions do not apply to a peace officer or member
of the national guard or U.S. armed forces who does any of the specified acts while
in the line of duty. This bill provides that the prohibitions do not apply to a private
security person who is acting in the line of duty and who meets all of the following
requirements: 1) he or she is either licensed by the department of regulation and
licensing (DORL) or has been issued a private security permit by the municipality
in which he or she is employed as a private security person; and 2) he or she has been
issued a certificate of proficiency to carry a firearm by DORL.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB115, s. 1 4Section 1. 167.31 (4) (a) 4. of the statutes is created to read:
AB115,1,65 167.31 (4) (a) 4. A private security person, as defined in s. 440.26 (1m), who
6meets all of the following requirements:

1a. He or she holds either a private detective license issued under s. 440.26 (2)
2(a) 2. or a private security permit issued under s. 440.26 (5).
AB115,2,43 b. He or she holds a certificate of proficiency to carry a firearm issued by the
4department of regulation and licensing.
AB115, s. 2 5Section 2. Initial applicability.
AB115,2,8 6(1)  This act first applies to private security persons who place, possess,
7transport, load or discharge a firearm as provided in section 167.31 (4) (a) (intro.) of
8the statutes on the effective date of this subsection.
