AB419, s. 36 24Section 36. 443.11 (6) of the statutes is amended to read:
AB419,15,10
1443.11 (6) The examining board, for reasons the interested section considers
2sufficient, may reissue a certificate of registration or a certificate of record to any
3person, or a certificate of authorization to any corporation, whose certificate has been
4revoked, providing 3 members of the architect section, 3 members of the landscape
5architect section, 3 members of the registered interior designer section, 3 members
6of the geologist section or 3 members of the engineer section of the examining board
7vote in favor of such reissuance. A new certificate of registration, certificate of record
8or certificate of authorization, to replace any certificate revoked, lost, destroyed or
9mutilated may be issued, subject to the rules of the examining board and the
10payment of the required fee.
AB419, s. 37 11Section 37. 443.13 of the statutes is amended to read:
AB419,15,25 12443.13 Disciplinary proceedings against designers of engineering
13systems.
The examining board may limit, suspend or revoke a permit or reprimand
14the permittee if the permittee is guilty of fraud or deceit in obtaining the permit,
15gross negligence, incompetency or misconduct in practice, signing documents not
16prepared by the permittee or under the permittee's control, knowingly aiding or
17abetting unauthorized designing of engineering systems as stated in s. 443.07 (3) by
18persons not granted permits under this chapter or conviction of a felony, subject to
19ss. 111.321, 111.322 and 111.335, or adjudication of mental incompetency by a court
20of competent jurisdiction. If, after a hearing conducted under the rules promulgated
21under s. 440.03 (1) before the designers' designer of engineering systems section of
22the examining board, two-thirds of the members of the section vote in favor of
23sustaining the charges, the examining board shall reprimand the permittee or limit,
24suspend or revoke the permit. The action of the examining board is subject to review
25under ch. 227.
AB419, s. 38
1Section 38. 443.16 of the statutes is amended to read:
AB419,16,12 2443.16 Change of name. No person may practice architecture, professional
3geology or professional engineering in this state, and no person who is registered as
4a landscape architect under this chapter may practice landscape architecture in this
5state, and no person who is registered as a registered interior designer under this
6chapter may practice interior design in this state
under any other given name or any
7other surname than that under which the person was originally licensed or
8registered to practice in this or any other state, in any instance in which if the
9examining board, after a hearing, finds that practicing under the changed name
10operates to unfairly compete with another practitioner or to mislead the public as to
11identity or to otherwise result in detriment to the profession or the public. This
12section does not apply to a change of name resulting from marriage or divorce.
AB419, s. 39 13Section 39. 443.17 of the statutes is amended to read:
AB419,16,22 14443.17 Seal or stamp; aiding unauthorized practice. No person who is
15registered under this chapter to practice architecture, landscape architecture,
16professional geology or professional engineering may impress his or her seal or
17stamp upon documents which have not been prepared by the person or under his or
18her direction and control, knowingly permit his or her seal or stamp to be used by any
19other person or in any other manner knowingly aid or abet the unauthorized practice
20of architecture, professional geology or professional engineering or the unauthorized
21use of the title "landscape architect" or "registered interior designer" by persons not
22authorized under this chapter.
AB419, s. 40 23Section 40. 443.18 (1) (a) of the statutes is amended to read:
AB419,17,1524 443.18 (1) (a) Any person who practices or offers to practice architecture,
25professional geology or professional engineering in this state, or who uses the term

1"architect", "professional geologist" or "professional engineer" as part of the person's
2business name or title, except as provided in s. 443.08 (6), or in any way represents
3himself or herself as an architect, a professional geologist or a professional engineer
4unless the person is registered or exempted in accordance with this chapter, or unless
5the person is the holder of an unexpired permit issued under s. 443.10 (1) (d), or any
6individual who uses the title "landscape architect" or "registered interior designer"
7in this state unless the person is registered or exempted in accordance with this
8chapter, or any person presenting or attempting to use as his or her own the
9certificate of registration of another, or any person who gives any false or forged
10evidence of any kind to the examining board or to any member of the examining board
11in obtaining a certificate of registration, or any person who falsely impersonates any
12other registrant of like or different name, or any person who attempts to use an
13expired or revoked certificate of registration, or violates any of the provisions of this
14section, may be fined not less than $100 nor more than $500 or imprisoned for not
15more than 3 months or both.
AB419, s. 41 16Section 41. 443.18 (2) (a) of the statutes is amended to read:
AB419,18,317 443.18 (2) (a) Injunction. If it appears upon complaint to the examining board
18by any person, or is known to the examining board that any person who is neither
19registered nor exempt under this chapter nor the holder of an unexpired permit
20under s. 443.10 (1) (d) is practicing or offering to practice, or is about to practice or
21to offer to practice, architecture, professional geology or professional engineering in
22this state, or is using the title "landscape architect" or "registered interior designer"
23in this state, the examining board or the attorney general or the district attorney of
24the proper county may investigate and may, in addition to any other remedies, bring
25action in the name and on behalf of this state against any such person to enjoin the

1person from practicing or offering to practice architecture, professional geology or
2professional engineering or from using the title "landscape architect" or "registered
3interior designer"
.
AB419, s. 42 4Section 42. 703.11 (2) (b) of the statutes is amended to read:
AB419,18,105 703.11 (2) (b) A survey of the property described in the declaration complying
6with minimum standards for property surveys adopted by the examining board of
7architects, landscape architects, registered interior designers, professional
8geologists, professional engineers, designers of engineering systems and land
9surveyors and showing the location of any unit or building located or to be located
10on the property.
AB419, s. 43 11Section 43 . Nonstatutory provisions.
AB419,18,15 12(1)  Examining board of architects, landscape architects, registered
13interior designers, professional geologists, professional engineers, designers of
14engineering systems and land surveyors; initial appointments of additional
15members
.
AB419,18,23 16(a)  Notwithstanding section 15.405 (2) (intro.) of the statutes, as affected by
17this act, the initial registered interior designer members of the examining board of
18architects, landscape architects, registered interior designers, professional
19geologists, professional engineers, designers of engineering systems and land
20surveyors need not be registered as registered interior designers under chapter 443
21of the statutes, as affected by this act, to be appointed to and serve as members of the
22examining board until the first day of the 13th month beginning after the effective
23date of this paragraph.
AB419,19,4 24(b)  Notwithstanding section 15.405 (2) (intro.) of the statutes, as affected by
25this act, the additional members of the examining board of architects, landscape

1architects, registered interior designers, professional geologists, professional
2engineers, designers of engineering systems and land surveyors shall be initially
3appointed by the first day of the 4th month beginning after the effective date of this
4paragraph for the following terms:
AB419,19,6 51.  One registered interior designer member and one public member, for terms
6expiring July 1, 1997.
AB419,19,8 72.  One registered interior designer member, for a term expiring on July 1,
81998.
AB419,19,9 93.  One public member, for a term expiring on July 1, 1999.
AB419,19,11 104.  One registered interior designer member, for a term expiring on July 1,
112000.
AB419,19,18 12(2)  Waiver of education and examination requirements. Notwithstanding
13sections 443.032 and 443.09 (4g) of the statutes, as created by this act, the examining
14board of architects, landscape architects, registered interior designers, professional
15geologists, professional engineers, designers of engineering systems and land
16surveyors shall register as a registered interior designer any individual who, not
17later than the first day of the 12th month beginning after the effective date of this
18subsection, does all of the following:
AB419,19,22 19(a)  Submits an application for registration as a registered interior designer to
20the examining board of architects, landscape architects, registered interior
21designers, professional geologists, professional engineers, designers of engineering
22systems and land surveyors.
AB419,19,23 23(b)  Pays the fee specified under section 440.05 (1) of the statutes.
AB419,19,24 24(c)  Satisfies section 443.09 (2) of the statutes, as affected by this act.
AB419,20,3
1(d)  Submits evidence satisfactory to the examining board that he or she has
2passed the building and barrier-free codes section of the examination administered
3by the National Council for Interior Design Qualification.
AB419,20,7 4(e)  Submits evidence satisfactory to the examining board of architects,
5landscape architects, registered interior designers, professional geologists,
6professional engineers, designers of engineering systems and land surveyors that he
7or she has done one of the following:
AB419,20,11 81.  Passed an examination administered by the National Council for Interior
9Design Qualification or an examination that the examining board determines is
10substantially equivalent to an examination administered by the National Council for
11Interior Design Qualification.
AB419,20,22 122.  Used or been identified by the title "interior designer" and has had at least
136 years of combined interior design education and experience. The 6 years of
14combined interior design education and experience required under this subdivision
15shall include at least 2 years of practical experience or employment in the practice
16of interior design, as defined in section 443.01 (3d) of the statutes, as created by this
17act, and at least 2 years of interior design education, except that the examining board
18of architects, landscape architects, registered interior designers, professional
19geologists, professional engineers, designers of engineering systems and land
20surveyors may permit an applicant to substitute 2 years of appropriate practical
21experience or employment in the practice of interior design for each year of required
22interior design education.
AB419, s. 44 23Section 44. Effective dates. This act takes effect on the first day of the 7th
24month beginning after publication, except as follows:

1(1) The treatment of sections 15.405 (2) (intro.), (a) and (b) of the statutes and
