AB83,1,2 1An Act to create 940.20 (7) of the statutes; relating to: battery to an emergency
2room worker and providing penalties.
Analysis by the Legislative Reference Bureau
Under current law, a person who intentionally causes bodily harm to another,
without the other person's consent, commits the crime of ordinary battery and, upon
conviction, is subject to a fine of not more than $10,000 or imprisonment for not more
than 9 months or both. The current law provides higher penalties for other types of
battery, such as battery to a law enforcement officer, probation and parole agent, fire
fighter, witness or juror. This bill creates a new battery crime if a person
intentionally causes bodily harm to an emergency room worker without the victim's
consent. Upon conviction, the violator is subject to a fine of not more than $10,000
or imprisonment for not more than 5 years or both.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB83, s. 1 3Section 1. 940.20 (7) of the statutes is created to read:
AB83,1,44 940.20 (7) (a) In this subsection:
AB83,1,75 1. "Emergency room" means a room or area in a hospital, as defined in s. 50.33
6(2), that is primarily used to provide emergency care, diagnosis or radiological
7treatment.
AB83,1,88 2. "Emergency room worker" means any of the following:
AB83,2,1
1a. An employe of a hospital who works in an emergency room.
AB83,2,32 b. A health care provider, whether or not employed by a hospital, who works
3in an emergency room.
AB83,2,64 3. "Health care provider" means any person who is licensed, registered,
5permitted or certified by the department of health and social services or the
6department of regulation and licensing to provide health care services in this state.
AB83,2,107 (b) Whoever intentionally causes bodily harm to an emergency room worker
8acting in an official capacity and the person knows or has reason to know that the
9victim is an emergency room worker, by an act done without the consent of the person
10so injured, is guilty of a Class D felony.
