25Wisconsin works benefit in the amount that is the proportionate share of the minor

1receiving the benefit under Wisconsin works, except as otherwise ordered by the
2court on the motion of a party. Amounts assigned to the state under this paragraph
3remain assigned to the state until that amount of benefits paid that represents the
4amount due as support or maintenance has been recovered. No amount of support
5that begins to accrue after the individual ceases to receive benefits under Wisconsin
6works may be considered assigned to this state. Any money received by the
7department in a month under an assignment to the state under this paragraph for
8a person applying for or participating in Wisconsin works may be paid to the
9individual applying for or participating in Wisconsin works.

AB100, s. 1817 23Section 1817. 49.148 (1m) (a) of the statutes is amended to read:

25who meets the eligibility requirements under s. 49.145 (2) and (3) may receive a

1monthly grant of $555 $673 unless another adult member of the custodial parent's

3works employment position or is employed in unsubsidized employment, as defined
4in s. 49.147 (1) (a)
. A Wisconsin works agency may not require a participant under
5this subsection to participate in any employment positions. Receipt of a grant under
6this subsection does not constitute participation in a Wisconsin works employment
7position for purposes of the time limits under s. 49.145 (2) (n) or 49.147 (3) (c), (4) (b)
8or (5) (b) 2. if the child is born to the participant not more than 10 months after the
9date that the participant was first determined to be eligible for assistance under s.
1049.19 or for a Wisconsin works employment position.
AB100, s. 1818 11Section 1818. 49.148 (2) of the statutes is created to read:
AB100,796,1812 49.148 (2) Electronic funds transfer. If the department makes benefit
13payments under sub. (1) (b) or (c) or (1m), it may make the payments by an electronic
14funds transfer system. If the department elects to make the payments by an
15electronic funds transfer system, the department may require a participant in a
16community service job or transitional placement or a participant under sub. (1m) to
17have an individual checking or savings account in a financial institution, as defined
18in s. 69.30 (1) (b), into which the department may electronically transfer the funds.

24a premium in an amount and in the manner established under s. 49.153 (4) (d).
AB100, s. 1820 25Section 1820. 49.148 (4) of the statutes is created to read:

149.148 (4) Drug testing. (a) A Wisconsin works agency shall require a
2participant in a community service job or transitional placement who, after August
322, 1996, was convicted in any state or federal court of a felony that had as an element
4possession, use or distribution of a controlled substance to submit to a test for use of
5a controlled substance as a condition of continued eligibility. If the test results are
6positive, the Wisconsin works agency shall decrease the pre-sanction benefit
7amount for that participant by not more than 15% for not fewer than 12 months, or
8for the remainder of the participant's period of participation in a community service
9job or transitional placement, if less than 12 months. If, at the end of 12 months, the
10individual is still a participant in a community service job or transitional placement
11and submits to another test for use of a controlled substance and if the results of the
12test are negative, the Wisconsin works agency shall discontinue the reduction under
13this subsection.
AB100,797,1714 (b) The Wisconsin works agency may require an individual who tests positive
15for use of a controlled substance under this subsection to participate in a drug abuse
16evaluation, assessment and treatment program as part of the participation
17requirement under s. 49.147 (4) (as) or (5) (bs).
AB100, s. 1821 18Section 1821. 49.15 of the statutes is created to read:
AB100,797,21 1949.15 Wisconsin works; 2-parent families. (1) Definition. In this section,
20"other parent" means a parent who is not a participant in a Wisconsin works
21employment position.
AB100,798,2 22(2) Requirements for nonparticipant parent. (a) If a participant in a
23Wisconsin works employment position resides with the other parent of a dependent
24child with respect to whom the participant is a custodial parent, the other parent
25shall participate for not fewer than 20 hours per week in any activity described under

1sub. (3) if the Wisconsin works group receives federally funded child care assistance
2on behalf of the dependent child.
AB100,798,53 (b) Paragraph (a) does not apply if the other parent is disabled, as defined by
4the department, or is caring for a severely disabled child, as defined by the
5department.
AB100,798,8 6(3) Prescribed work activities. An individual who is subject to the work
7requirement under sub. (2) may satisfy the requirement only by participating in any
8of the following activities:
AB100,798,99 (a) Unsubsidized employment, as defined in s. 49.147 (1) (a).
AB100,798,1010 (b) Subsidized employment, as defined by the department.
AB100,798,1211 (c) If sufficient private sector employment is not available, work experience, as
12defined by the department.
AB100,798,1313 (d) On-the-job training, as defined by the department.
AB100,798,1414 (e) A community service program, as defined by the department.
AB100,798,20 15(4) Single grant or subsidy. Notwithstanding the number of adults in a
16Wisconsin works group that are engaged in work activities in a month, no person,
17other than a participant in a community service job or transitional placement may
18receive a grant under s. 49.148 (1) (b) or (c) and no subsidy may be paid to an employer
19under s. 49.147 (3) (a) except on behalf of a participant in a trial job, regardless of the
20number of members of the Wisconsin works group that the employer employs.
AB100,799,3 21(5) Sanction. The Wisconsin works agency may reduce the monthly grant
22amount of a participant in a community service job or transitional placement by
23$5.15 for every hour that an individual who is in the participant's Wisconsin work
24group and who is subject to the work requirement under sub. (2) fails to meet the
25work requirement in a month without good cause. Good cause shall be determined

1by the financial and employment planner in accordance with rules promulgated by
2the department. Good cause shall include required court appearances for a victim
3of domestic abuse.

15participate in a Wisconsin works employment position component if the

or an individual who is subject to the work requirement under s. 49.15 (2)
17demonstrates a refusal to participate if
any of the following applies:
