AB735,1,5 1An Act to repeal 45.25 (4) (d) and 45.396 (10); to amend 45.397 (2) (a) and 45.74
2(7); and to create 45.385 of the statutes; relating to: veterans part-time
3classroom study, veterans tuition and fee reimbursement, veterans retraining
4grants, authority to construct and operate residential, treatment and nursing
5care facilities in southeastern Wisconsin and veterans housing loans.
Analysis by the Legislative Reference Bureau
Under current law, an eligible veteran may receive reimbursement for the
tuition and fees paid for enrolling as an undergraduate in any institution in the
University of Wisconsin System or in a technical college, up to 50% of the cost for a
state resident for an equivalent undergraduate course at the University of
Wisconsin-Madison. Currently, veterans are eligible for reimbursement for the
tuition and fees of a correspondence course or part-time classroom study from an
institution of higher education, up to 50% of the cost for a state resident for an
equivalent undergraduate course at the University of Wisconsin-Madison. The
department of veterans affairs (DVA) may, under current law, provide
reimbursement for these costs for the fiscal year in which the course was completed
or in which the academic term during which the course was taken ended, whichever
is earlier. This bill removes the time limit on DVA's ability to provide reimbursement
for these costs.
Under current law, an eligible veteran who is enrolled in a training course in
a technical college or in an approved proprietary school or engaged in a structured

on-the-job training program is eligible for a retraining grant of up to $3,000 for the
costs of that course or training. This bill removes proprietary school training from
eligibility for a retraining grant under this program.
This bill gives DVA, subject to building commission procedures and approval,
authority to construct or renovate and operate residential, treatment and nursing
care facilities in southeastern Wisconsin. The bill gives DVA authority to acquire by
gift, purchase or condemnation lands necessary for those facilities.
Under current law, as created in the budget bill (1997 Wisconsin Act 27), an
eligible veteran may not receive a veteran's home loan to purchase a home if the price
of the home being purchased exceeds 2.5 times the median price of a home in the
state. This bill prohibits an eligible veteran from receiving a veteran's home loan for
any eligible purpose, which includes the purchase of a home, improvements to a
home or refinancing of a home loan, if the amount of the loan exceeds 2.5 times the
median price of a home in the state.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB735, s. 1 1Section 1. 45.25 (4) (d) of the statutes is repealed.
AB735, s. 2 2Section 2. 45.385 of the statutes is created to read:
AB735,2,11 345.385 Veterans residential, treatment and nursing care facilities.
4Subject to authorization under ss. 13.48 (10) and 20.924 (1), the department of
5veterans affairs may construct or renovate and operate residential, treatment and
6nursing care facilities in southeastern Wisconsin and may employ such personnel as
7are necessary for the proper management of the facilities. The department may
8acquire by gift, purchase or condemnation lands necessary for the purposes of the
9facilities. Title to any properties acquired under this section shall be taken in the
10name of this state. Every deed of conveyance shall be immediately recorded in the
11office of the proper register of deeds and filed with the secretary of state.

13repealed.

1Section 4. 45.397 (2) (a) of the statutes, as affected by 1997 Wisconsin Act 27,
2is amended to read:

9amended to read:

11of the home loan exceeds 2.5 times the median price of a home in this state if the
12person is applying for a loan for the purchase of a home
. The department shall
13promulgate a rule establishing establish the median price of a home in this state for
14each fiscal year that is determined by using the most recent housing price index
15generated by the Wisconsin Realtors Association before July 1.
