SB210,1,3 1An Act to amend 256.01 (6), (7), (8) and (9) and 256.15 (2) (a); and to create
2256.15 (2) (c) of the statutes; relating to: exempting out-of-state emergency
3medical services personnel from licensure requirements.

This bill permits an out-of-state person providing emergency medical services
(EMS) to act as an ambulance service provider, emergency medical technician, or
first responder without holding a license, training permit, or certificate in this state
when responding to a request for mutual aid if the person holds a valid license,
training permit, or certificate in the state from which that person is responding. As
used in this bill, "emergency medical technician" refers to an emergency medical
technician-basic, emergency medical technician-intermediate, or emergency
medical technician-paramedic. Generally, under current law, a person may not act
as or advertise for the provision of services as an ambulance service provider,
emergency medical technician, or first responder unless that person holds the
required Wisconsin license, training permit, or certificate. This bill creates a limited
exemption from that requirement for those holding appropriate credentials in
another state when they respond from that state to a request for mutual aid from
within this state.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1Section 1. 256.01 (6), (7), (8) and (9) of the statutes, as affected by 2015
2Wisconsin Act .... (Senate Bill 182), are amended to read:
SB210,2,63 256.01 (6) "Emergency medical technician — basic" means an individual who
4is licensed by the department to administer basic life support and to properly handle
5and transport sick, disabled or injured individuals or is exempt under s. 256.15 (2)
6(b) or (c).
SB210,2,9 7(7) "Emergency medical technician — intermediate" means an individual who
8is licensed by the department as an emergency medical technician — intermediate
9under s. 256.15 (5) or is exempt under s. 256.15 (2) (b) or (c).
SB210,2,14 10(8) "Emergency medical technician — paramedic" means an individual who is
11specially trained in emergency cardiac, trauma and other lifesaving or emergency
12procedures in a training program or course of instruction prescribed by the
13department and who is examined and licensed as an emergency medical technician
14— paramedic under s. 256.15 (5) or is exempt under s. 256.15 (2) (b) or (c).
SB210,2,20 15(9) "First responder" means a person who is certified by the department as a
16first responder under s. 256.15 (8) (a) or is exempt under s. 256.15 (2) (b) or (c) and
17who, as a condition of employment or as a member of an organization that provides
18emergency medical care before hospitalization, provides emergency medical care to
19a sick, disabled or injured individual before the arrival of an ambulance, but who
20does not provide transportation for a patient.

24pars. (b) and (c), no person may act as or advertise for the provision of services as an
25ambulance service provider unless the person holds an ambulance service provider

1license issued under this section. Except when acting under s. 257.03 and except as
2provided in par. pars. (b) and (c), no individual may act as or advertise for the
3provision of services as an emergency medical technician unless he or she holds an
4emergency medical technician license or training permit issued under sub. (5).
5Except when acting under s. 257.03 and except as provided in par. pars. (b) and (c),
6no individual may act as or advertise for the provision of services as a first responder
7unless he or she holds a first responder certificate issued under sub. (8).
SB210,3 8Section 3. 256.15 (2) (c) of the statutes is created to read:
SB210,3,119 256.15 (2) (c) Notwithstanding par. (a), a person may act as an ambulance
10service provider, emergency medical technician, or first responder without a license,
11training permit, or certificate described under par. (a) if all of the following apply:
SB210,3,1412 1. The person holds a valid license, training permit, certificate, or other
13credential allowing the person to act as an ambulance service provider, emergency
14medical technician, or first responder in another state.
SB210,3,1815 2. The person is acting in response to a request for mutual aid and responding
16from the state in which that person holds a license, training permit, certificate, or
17other credential allowing the person to act as an ambulance service provider,
18emergency medical technician, or first responder.
