AB389,1,3 1An Act to create 942.09 (4) and 948.015 (10) of the statutes; relating to:
2soliciting an intimate representation from a minor and providing a criminal
3penalty.
Analysis by the Legislative Reference Bureau
This bill creates a crime for soliciting a sexually explicit photograph, recording,
or other representation from a person who is under the age of 18. Under the bill, if
a person who is over the age of 18 solicits such a representation from a person who
he or she believes is under the age of 18, he or she is guilty of a Class A misdemeanor.
Under current law, there is no penalty for soliciting such a representation from a
minor.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB389,1 4Section 1. 942.09 (4) of the statutes is created to read:
AB389,1,75 942.09 (4) (a) Whoever solicits an intimate or private representation from a
6person who the actor believes or has reason to believe has not attained the age of 18
7years is guilty of a Class A misdemeanor.

1(b) Paragraph (a) does not apply if the person who solicits the intimate or
2private representation is under the age of 18.
AB389,2 3Section 2 . 948.015 (10) of the statutes is created to read:
AB389,2,54 948.015 (10) Section 942.09 (4) (a), relating to solicitation of an intimate or
5private representation of a child.
