AB477,1,3 1An Act to repeal 115.435 (3); to renumber and amend 115.435 (1); to amend
2115.435 (2); and to create 115.435 (1g) of the statutes; relating to:
3supplemental aid for school districts with a large area.
Analysis by the Legislative Reference Bureau
This bill repeals the administrative rules promulgated by the Department of
Public Instruction to administer a supplemental aid program for a school district
having 500 or fewer pupils and that is at least 200 square miles and incorporates the
repealed provisions into current law. The bill also changes, from enrollment to
membership, the terminology used to refer to the number of pupils counted to
determine the school district's eligibility to receive the supplemental aid.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB477,1 4Section 1. 115.435 (1) of the statutes is renumbered 115.435 (1r), and 115.435
5(1r) (a), (b) and (c), as renumbered, are amended to read:
AB477,1,76 115.435 (1r) (a) The school district had an enrollment district's membership in
7the previous school year of fewer was no more than 500 pupils.

1(b) The school district is at least 200 square miles in area. The clerks of the
2municipalities within which the school district is located shall verify the school
3district's area on a form prepared by the department.
AB477,2,94 (c) At least 80 percent of the real property in the school district is exempt from
5taxation under s. 70.11, taxed as forest croplands under subch. I of ch. 77, owned by
6or held in trust for a federally recognized American Indian tribe, or owned by the
7federal government. The clerks of the municipalities within which the school district
8is located shall verify the information required under this paragraph on a form
9prepared by the department.
AB477,2 10Section 2. 115.435 (1g) of the statutes is created to read:
AB477,2,1211 115.435 (1g) In this section, “membership" has the meaning given in s. 121.004
12(5).
AB477,3 13Section 3. 115.435 (2) of the statutes is amended to read:
AB477,2,1914 115.435 (2) No later than June 30 of the current school year, the department
15shall, from the appropriation under s. 20.255 (2) (ad), pay each school district that
16satisfies the criteria under sub. (1) (1r) $350 for each pupil enrolled in multiplied by
17the school district membership in the previous school year. If the appropriation
18under s. 20.255 (2) (ad) is insufficient to pay the full amount under this subsection,
19the funds shall be prorated among the entitled school districts.
AB477,4 20Section 4. 115.435 (3) of the statutes is repealed.
AB477,5 21Section 5. Chapter PI 10 of the administrative code is repealed.
