1An Act to amend 346.04 (2t) and 346.04 (3) of the statutes;
relating to:
2obedience to authorized emergency vehicles operated by law enforcement
3officers.
Analysis by the Legislative Reference Bureau
Under current law, no operator of a vehicle, after having received a visible or
audible signal to stop his or her vehicle from a traffic officer or marked police vehicle,
shall knowingly resist by failing to stop his or her vehicle or knowingly flee or attempt
to elude any officer so as to interfere with or endanger the operation of the police
vehicle, the traffic officer, other vehicles, or pedestrians.
This bill replaces the reference to “marked police vehicle” with “an authorized
emergency vehicle that the operator knows or reasonably should know is being
operated by a law enforcement officer.”
