AB850,1,2 1An Act to amend 29.179 (2) of the statutes; relating to: transfer of hunting,
2fishing, and trapping approvals to persons with disabilities.

Under current law, the Department of Natural Resources issues approvals that
authorize the hunting, fishing, or trapping of specified wild animals. Current law
generally prohibits a person from transferring an approval to another person, with
some exceptions. One exception is that certain approvals may be transferred to a
minor or a person with a disability if the holder of the approval applies prior to the
first day of the applicable open season, if the minor or person with a disability is
eligible to use the approval, and if the minor or person with a disability has not
previously been transferred an approval of that type.
This bill eliminates the limitation that a person with a disability may be
transferred an approval only if he or she has not previously been transferred that
type of approval.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
AB850,1 3Section 1. 29.179 (2) of the statutes is amended to read:
AB850,2,114 29.179 (2) Application; generally. Upon application by a holder of an approval
5to transfer the approval to a minor or a disabled person, and upon the payment of any

1fee required under sub. (3), the department shall transfer the approval to the minor
2or the disabled person if the application is made no later than the 15 days
3immediately preceding the first day of the applicable open season and if the minor
4or the disabled person has not been previously transferred that type of approval
5under this section and
if the minor or disabled person is otherwise eligible to use the
6approval. The department may not transfer an approval to a minor who has
7previously been transferred that type of approval under this section.
The
8department may transfer a sturgeon spearing license under this subsection only
9during the period beginning on the October 1st of each year and ending on the day
10that is the 15th day preceding the first day of the open season for the spearing of lake
11sturgeon that follows that October 1st.
AB850,2 12Section 2. Initial applicability.
AB850,2,1413 (1) This act first applies to an application to transfer an approval that is
14submitted on the effective date of this subsection.
