AB907,22,13 (c) Evidence of successful passage of the jurisprudence examination unless the applicant has previously passed the examination in the process of obtaining a substance abuse counselor-in-training or substance abuse counselor credential.

AB907,22,14 (d) Evidence of one of the following:

AB907,22,15 1. Holding a substance abuse counselor credential.

AB907,22,18 2. Completion of 360 hours of substance use disorder specialized education through a postsecondary institution or department-approved education program. The 360 hours shall be in all of the following:

AB907,22,19 a. Sixty hours in assessment training.

AB907,22,20 b. Sixty hours in counseling training.

AB907,22,21 c. Sixty hours in case management.

AB907,22,22 d. Sixty hours in patient education.

AB907,22,23 e. Sixty hours in professional responsibility.

AB907,22,24 f. Six hours in boundaries and ethics.

AB907,22,25 g. Fifty-four hours in electives in any of the subjects in subds. 2. a. to f.

AB907,23,2 (e) Evidence of an associate's degree or higher in a behavioral science field from an accredited university or college.

AB907,23,4 (f) Evidence of successful passage of the National Association for Alcoholism and Drug Abuse Counselors' NCAC I exam.

AB907,23,9 (g) Evidence of completion of 5,000 hours of work experience performing the practice dimensions, supervised by an individual under ch. SPS 162 within the 5 years immediately preceding the date of application. The 5,000 hours may include any work experience hours obtained as a requirement of the substance abuse counselor credential.

AB907,23,13 (h) For applicants who have a pending criminal charge or have been convicted of a crime, all related information necessary for the department to determine whether the circumstances of the pending criminal charge or conviction are substantially related to the practice of substance abuse counseling.

AB907,23,18 (2) An applicant for certification as a clinical substance abuse counselor who is credentialed by the marriage and family therapy, professional counseling, and social work examining board at the master's level or higher shall submit evidence satisfactory to the department of the applicant's current credential under ch. 457, Stats.

AB907,23,20 SPS 161.04 Clinical supervisor-in-training application. An applicant for certification as a clinical supervisor-in-training shall submit all of the following:

AB907,23,21 (1) An application form.

AB907,23,22 (2) A fee as determined by the department under s. 440.05, Stats.

AB907,24,2 (3) Evidence of current employment, a written offer of employment, or an agreement authorizing volunteer hours as a clinical supervisor of counselors providing substance use disorder treatment services who are certified under s. 440.88, Stats., or under ch. 457, Stats.

AB907,24,3 (4) Evidence of one of the following:

AB907,24,4 (a) Holding an active clinical substance abuse counselor credential.

AB907,24,6 (b) Holding an active credential under ch. 457, Stats., at the master's level or higher.

AB907,24,9 SPS 161.05 Intermediate clinical supervisor or independent clinical supervisor application. An applicant for certification as an intermediate clinical supervisor or independent clinical supervisor shall submit all of the following:

AB907,24,10 (1) An application form.

AB907,24,11 (2) A fee as determined by the department under s. 440.05, Stats.

AB907,24,12 (3) Evidence of holding an active credential of one of the following:

AB907,24,13 (a) Clinical substance abuse counselor.

AB907,24,14 (b) A credential under ch. 457, Stats., at the master's level or higher.

AB907,24,18 (4) Evidence of 2 years of clinical supervisory experience as a supervisor-in-training or intermediate supervisor within the last 5 years as the supervisor of counselors certified under s. 440.88, Stats., or having a credential under ch. 457, Stats.

AB907,24,19 (5) Evidence of one of the following:

AB907,24,20 (a) Holding an intermediate clinical supervisor credential.

AB907,24,22 (b) Successful completion of 30 hours of education in clinical supervision, including a minimum of 6 hours of training in each of the following:

AB907,24,23 1. Assessment and evaluation.

AB907,24,24 2. Counselor development.

AB907,24,25 3. Management and administration.

AB907,25,1 4. Professional responsibility.

AB907,25,3 (c) Holding an American Association for Marriage and Family Therapy supervisor certification.

AB907,25,5 (6) Evidence of successful passage of the National Association of Alcoholism Counselors and Trainers' NCSE exam.

AB907,25,8 SPS 161.06 Prevention specialist-in-training application. An applicant for certification as a prevention specialist-in-training shall submit all of the following:

AB907,25,10 (2) A fee as determined by the department under s. 440.05, Stats.

AB907,25,12 (3) Evidence of successful completion of 40 hours of approved education, including 5 hours specific to ethics, in the following content areas:

AB907,25,13 (a) Planning and evaluation.

AB907,25,14 (b) Prevention education and service delivery.

AB907,25,15 (c) Communication.

AB907,25,16 (d) Community organization.

AB907,25,17 (e) Public policy and environmental change.

AB907,25,18 (f) Professional growth and responsibility.

AB907,25,20 SPS 161.07 Prevention specialist application. An applicant for certification as a prevention specialist shall submit all of the following:

AB907,25,21 (1) An application form.

AB907,25,22 (2) A fee as determined by the department under s. 440.05, Stats.

AB907,25,23 (3) Evidence of successful passage of the jurisprudence examination.

AB907,26,3 (4) Evidence of successful completion of 120 hours of approved education, including 50 hours specific to alcohol, tobacco, and other substance abuse and 6 hours specific to ethics, in the following content areas:

AB907,26,4 (a) Planning and evaluation.

AB907,26,5 (b) Prevention education and service delivery.

AB907,26,6 (c) Communication.

AB907,26,7 (d) Community organization.

AB907,26,8 (e) Public policy and environmental change.

AB907,26,9 (f) Professional growth and responsibility.

AB907,26,14 SPS 161.08 Reciprocity. An applicant holding a current credential in good standing as a substance abuse counselor, clinical supervisor, or prevention specialist or its equivalent in another state or U.S. territory with requirements for the credential that are not lower than specified in this chapter shall submit all of the following:

AB907,26,15 (1) An application form.

AB907,26,16 (2) A fee as determined by the department under s. 440.05, Stats.

AB907,26,20 (3) For applicants who have a pending criminal charge or have been convicted of a crime, all related information necessary for the department to determine whether the circumstances of the pending criminal charge or conviction are substantially related to the practice of substance abuse counseling.

AB907,26,25 (4) For applicants who have had disciplinary or adverse action taken on their substance abuse counselor, clinical supervisor, or prevention specialist credential or its equivalent, all related information necessary for the department to determine whether the circumstances of the disciplinary action or adverse action warrant denial of the application.

AB907,27,1 (5) Evidence of successful passage of jurisprudence examination.

AB907,54 Section 54. SPS 163.01 of the administrative code is repealed.

AB907,55 Section 55. SPS 163.02 (1) of the administrative code is renumbered SPS 163.02 and amended to read:

AB907,27,11 SPS 163.02 Substance abuse counselor-in-training; limited scope of practice. The granting of a substance abuse counselor-in-training certificate does not denote or assure competency to provide substance use disorder counseling. A substance abuse counselor-in-training may provide services in any of the core functions, except counseling, if authorized and documented by the clinical supervisor. A clinical supervisor may only authorize a substance abuse counselor-in-training to provide counseling in accordance with sub. (2).

AB907,57 Section 57. SPS 163.02 (3) of the administrative code is repealed.

AB907,58 Section 58. SPS 164.01 (2) (fm) of the administrative code is created to read:

AB907,27,17 SPS 164.01 (2) (fm) Allowing students or supervisees to perform services for which the substance abuse professional is not qualified by education, training, or experience to perform.

AB907,59 Section 59. SPS 164.01 (2) (j) of the administrative code is amended to read:

AB907,27,21 SPS 164.01 (2) (j) Discriminating in practice on the basis of age, race, color, sex, religion, creed, national origin, ancestry, disability, gender identity, or sexual orientation.

AB907,60 Section 60. SPS 164.01 (2) (k) of the administrative code is amended to read:

AB907,28,2 SPS 164.01 (2) (k) Revealing to other personnel not engaged in the care of a patient or to members of the public information which concerns a patient's identity or condition unless release of the information is authorized by the patient or required or authorized by law. This provision shall not be construed to prevent a credential holder from cooperating with the department in the investigation of complaints.

AB907,61 Section 61. SPS 164.01 (2) (x) of the administrative code is amended to read:

AB907,28,6 SPS 164.01 (2) (x) Failing to report to the department or to institutional supervisory personnel any violation of the rules of this chapter by a substance abuse professional.

AB907,62 Section 62. SPS 164.01 (2) (y) of the administrative code is created to read:

AB907,28,8 SPS 164.01 (2) (y) Disclosing supervisee confidences, except as follows:

AB907,28,9 1. As mandated by law.

AB907,28,10 2. To prevent a clear and immediate danger to a person.

AB907,28,12 3. In educational or training settings where there are multiple supervisors who share responsibility for training of the supervisee.

AB907,63 Section 63. Chapter SPS 165 of the administrative code is repealed and recreated to read:

AB907,28,16 RENEWAL AND REINSTATEMENT

AB907,28,19 SPS 165.01 Late renewal. (1) General. A person with an expired credential under s. 440.88, Stats., may not reapply for a credential using the initial application process.

AB907,28,21 (2) Renewal within 5 years. A person renewing a credential under s. 440.88, Stats., within 5 years after its expiration shall do all of the following:
