19or, salesperson, or professional leasing and renting agent shall submit to the board
20an application for a license. The application shall be in such form as the board
21prescribes and shall include the following:
SB520,17 22Section 17. 452.09 (1) (e) of the statutes is amended to read:
SB520,8,223 452.09 (1) (e) Any other information that the board may reasonably require to
24enable it to determine the competency of each applicant, including each business
25representative of the business entity, to transact the business of a broker or,

1salesperson, or professional leasing and renting agent in a manner that safeguards
2the interests of the public.
SB520,18 3Section 18. 452.09 (2) (e) of the statutes is created to read:
SB520,8,64 452.09 (2) (e) Except as provided in a reciprocal agreement under s. 452.05 (3),
5each applicant for a professional leasing and renting agent's license shall submit to
6the board evidence satisfactory to the board of all of the following:
SB520,8,87 1. Successful completion of an educational program in professional leasing and
8renting approved by the board under s. 452.05 (1) (c).
SB520,8,109 2. Proof that the applicant was at least 18 years of age at the time of enrollment
10in the educational program described in subd. 1.
SB520,19 11Section 19. 452.09 (3) (e) of the statutes is created to read:
SB520,8,2112 452.09 (3) (e) In determining competency to engage in professional leasing and
13renting, the board shall require proof that an applicant for a professional leasing and
14renting agent's license has a fair knowledge of obligations under s. 106.50 and federal
15fair housing laws, leasing or renting to tenants who use service animals, verifying
16legal forms of identification, and other duties and responsibilities related to
17professional leasing and renting. The board shall require an applicant to pass an
18examination on these subjects approved by the board. The board shall deny a license
19to an applicant receiving a failing grade, as established by the rules of the board, on
20any examination given under this paragraph, but any applicant may review his or
21her examination results in a manner established by rules of the board.
SB520,20 22Section 20. 452.11 (1) of the statutes is amended to read:

24leasing and renting agent
by conforming to all the provisions of this chapter.
SB520,21 25Section 21. 452.12 (1) of the statutes is amended to read:

1452.12 (1) Expiration. A license granted by the board entitles the holder to act
2as a broker or, salesperson, or professional leasing and renting agent, as the case may
3be, until the applicable renewal date specified under s. 440.08 (2) (a).
SB520,22 4Section 22. 452.12 (5) (c) of the statutes is amended to read:

6professional leasing and renting agent
who is an individual shall submit proof of
7attendance at and successful completion of continuing education programs or
8courses approved under s. 452.05 (1) (g).
SB520,23 9Section 23 . 452.12 (5) (d) of the statutes is amended to read:

11professional leasing and renting agent
who is an individual shall complete the form
12under s. 452.05 (1) (i).
SB520,24 13Section 24. 452.14 (1) of the statutes is amended to read:
SB520,9,1814 452.14 (1) The board shall, upon motion of the secretary or his or her designee
15or upon its own determination, conduct investigations and, as appropriate, may hold
16hearings and make findings, if the board or the department receives credible
17information that a broker or, salesperson, or professional leasing and renting agent
18has violated this chapter or any rule promulgated under this chapter.
SB520,25 19Section 25. 452.14 (3) (i) of the statutes is amended to read:
SB520,9,2220 452.14 (3) (i) Demonstrated incompetency to act as a broker or, salesperson, or
21professional leasing and renting agent
, whichever is applicable, in a manner which
22safeguards the interests of the public.
SB520,26 23Section 26. 452.20 of the statutes is amended to read:
SB520,9,25 24452.20 Limitation on actions for commissions. No person engaged in the
25business or acting in the capacity of a broker or , salesperson, or professional leasing

1and renting agent
within this state may bring or maintain an action in the courts of
2this state for the collection of a commission or compensation for the performance of
3any act mentioned in this chapter without alleging and proving that he or she was
4a duly licensed broker or, salesperson , or professional leasing and renting agent at
5the time the alleged cause of action arose.
SB520,27 6Section 27. 452.22 (2) of the statutes is amended to read:
SB520,10,147 452.22 (2) The certificate of the chairperson of the board or his or her designee
8to the effect that a specified individual or business entity is not or was not on a
9specified date the holder of a broker's or, salesperson's, or professional leasing agent's
10license, or that a specified license was not in effect on a date specified, or as to the
11issuance, limitation, suspension, or revocation of any license or the reprimand of any
12licensee, the filing or withdrawal of any application or its existence or nonexistence,
13is prima facie evidence of the facts stated in the certificate for all purposes in any
14action or proceedings.
SB520,28 15Section 28 . 452.25 (1) (a) of the statutes is amended to read:
SB520,10,1916 452.25 (1) (a) Notwithstanding ss. 111.321, 111.322, and 111.335, and except
17as provided in pars. (b) to (e), no applicant who is an individual may be issued a
18broker's or, salesperson's, or professional leasing and renting agent's license if the
19applicant has been convicted of a felony.
SB520,29 20Section 29 . 452.25 (1) (c) 2. of the statutes is amended to read:

22applicant bearing upon his or her suitability for licensure as a broker or, salesperson,

SB520,30 24Section 30 . 452.25 (1) (e) of the statutes is amended to read:

1452.25 (1) (e) If the board makes a determination under par. (c) to allow an
2applicant to be granted a broker's or, salesperson's, or professional leasing and
3renting agent's
license, the applicant shall be granted the license if the applicant
4satisfies all other requirements for granting the license.
SB520,31 5Section 31 . 452.25 (2) (b) of the statutes is amended to read:
SB520,11,96 452.25 (2) (b) No applicant may be issued an initial broker's or, salesperson's,
7or professional leasing and renting agent's
license, and no applicant may renew such
8a license, if the applicant has violated par. (a) and failed to pay any forfeiture
9assessed by the board under s. 452.14 (4r) for that violation.
SB520,32 10Section 32 . 452.30 (7) (b) of the statutes is renumbered 452.30 (7) (b) 1. and
11amended to read:
SB520,11,1412 452.30 (7) (b) 1. A Except as provided in subd. 2., a salesperson may not engage
13in independent real estate practice and may engage in real estate practice only when
14associated with a firm.
SB520,33 15Section 33 . 452.30 (7) (b) 2. of the statutes is created to read:
SB520,11,1816 452.30 (7) (b) 2. A salesperson who holds a professional leasing and renting
17agent license may engage in professional leasing and renting independent of a real
18estate firm.
SB520,34 19Section 34 . Nonstatutory provisions.
SB520,11,2320 (1) Notwithstanding section 15.405 (11m) of the statutes, the initial member
21appointed to fill the seat on the the real estate examining board that is held by a
22professional leasing and renting agent under s. 15.405 (11m) of the statutes need not
23be licensed under chapter 452 of the statutes.
SB520,12,324 (2) Notwithstanding section 15.407 (5) of the statutes, the initial member
25appointed to fill the seat on the council on real estate curriculum and examinations

1that is held by a professional leasing and renting agent under s. 15.407 (5) of the
2statutes need not be licensed under chapter 452 of the statutes and need not have
32 years of experience with a license under chapter 452 of the statutes.
SB520,35 4Section 35 . Effective dates. This act takes effect on the first day of the 13th
5month beginning after publication, except as follows:
SB520,12,76 (1) The treatment of sections 15.405 (11m) and 15.407 (5) of the statutes takes
7effect on the day after publication.
