SB67,1,2 1An Act to amend 939.645 (2) (a), (b) and (c) of the statutes; relating to: penalty
2enhancers for certain crimes.

This bill increases the penalty enhancers the court may impose on the sentence
of a person who commits what is commonly known as a “hate crime," which is a crime
in which the perpetrator selects the victim due to the victim's race, religion, color,
disability, sexual orientation, national origin, or ancestry. The bill does the following:
1) for a misdemeanor that is lower than a Class A misdemeanor, increases the revised
maximum fine from $10,000 to $20,000; 2) for a Class A misdemeanor, increases the
revised maximum fine from $10,000 to $20,000 and increases the revised maximum
term of imprisonment from two years to four years; and 3) for a felony, changes the
maximum increase of the fine from $5,000 to $10,000 and changes the maximum
increase in the term of imprisonment from five years to ten years.
The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:
SB67,1 3Section 1. 939.645 (2) (a), (b) and (c) of the statutes are amended to read:
SB67,2,24 939.645 (2) (a) If the crime committed under sub. (1) is ordinarily a
5misdemeanor other than a Class A misdemeanor, the revised maximum fine is

1$10,000 $20,000 and the revised maximum term of imprisonment is one year in the
2county jail.
SB67,2,63 (b) If the crime committed under sub. (1) is ordinarily a Class A misdemeanor,
4the penalty increase under this section changes the status of the crime to a felony and
5the revised maximum fine is $10,000 $20,000 and the revised maximum term of
6imprisonment is 2 4 years.
SB67,2,107 (c) If the crime committed under sub. (1) is a felony, the maximum fine
8prescribed by law for the crime may be increased by not more than $5,000 $10,000
9and the maximum term of imprisonment prescribed by law for the crime may be
10increased by not more than 5 10 years.
