SPS 316.700(2) (2)General requirements. This is a department rule in addition to the requirements in 2011 and 2017 NEC 700.12 (intro.): The enclosure of the alternate source of power located outdoors for emergency systems shall be located at least 10 feet horizontally from any combustible portion of a Type III, Type IV, or Type V building and at least 20 feet from an outdoor electrical transformer, electrical metering, service equipment, or normal power distribution equipment. These dimensions may be reduced where a noncombustible barrier is installed that extends at least 3 feet beyond each side of the alternate power source and transformer. The height of the barrier shall be at least one foot above the top of the transformer, electrical metering, service equipment, or alternate power source, whichever is higher.

SPS 316.915 SPS 316.915 Definitions. In this subchapter:
SPS 316.915(1) (1) “Certified inspector" means a certified commercial electrical inspector.
SPS 316.915(2) (2) “Commercial electrical inspector" means a person who conducts inspections of electrical construction of farms, public buildings and places of employment.
SPS 316.915(4) (4) “Electrical construction" means the installation of electrical wiring.
SPS 316.915(5) (5) “Electrical contractor" means any person, firm or corporation engaged in the business of erecting, installing, altering, repairing, servicing or maintaining electrical wiring.
SPS 316.915(9) (9) “Independent inspection agency" means any corporation, partnership or sole proprietor, other than a municipal corporation, that performs inspections of buildings.
SPS 316.915(11) (11) “Person" includes all partnerships, associations, and bodies politic or corporate.

SPS 316.920 SPS 316.920 Authority.
SPS 316.920(1)(1) Departmental authority. Pursuant to ss. 101.82 and 101.84, Stats., the department is granted the authority and jurisdiction over the inspection of electrical construction of farms, public buildings and places of employment.
SPS 316.920(2) (2)Municipal authority.
SPS 316.920(2)(a)(a) Jurisdiction conditions. Pursuant to s. 101.86 (1), Stats., municipalities may exercise jurisdiction over inspection of electrical construction in public buildings and places of employment by passage of ordinances, providing all of the following conditions are complied with:
SPS 316.920(2)(a)1. 1. The municipality's ordinances meet the minimum requirements of this subchapter.
SPS 316.920(2)(a)2. 2. The municipality notifies the department at least 30 days prior to the date upon which the municipality intends to assume the jurisdiction.
SPS 316.920(2)(a)3. 3. The municipality provides the department with a copy of its electrical ordinances and subsequent revisions to the ordinances.
SPS 316.920(2)(a)4. 4. The municipality's ordinances adopt this chapter in its entirety.
SPS 316.920(2)(a)5. 5. The municipality employs or contracts with certified inspectors or independent inspection agencies to perform electrical inspection functions.
SPS 316.920(2)(a)6. 6. The municipality provides the department with the names of its certified inspectors or independent inspection agencies employed or contracted by the municipality.
SPS 316.920(2)(a)7. 7. The municipality provides the department with any information requested by the department relative to the electrical inspection of public buildings and places of employment.
SPS 316.920 Note Note: Section 13.48 (13), Stats., exempts state buildings from local ordinances or regulations relating to building construction, permits and similar restrictions.
SPS 316.920(2)(b) (b) Joint jurisdiction. Municipalities may jointly exercise the jurisdiction granted in par. (a).
