2of the department of justice.

8transferred to the department of justice.

(2q) Voluntary employee furlough. Any appointing authority of a state
18agency, as defined in section 20.001 (1) of the statutes, may permit any employee of
19that agency, other than an employee who is an elected official or is nominated or
20appointed by the governor for a fixed term to his or her position, to take a voluntary
21unpaid leave of absence during the 2001-03 fiscal biennium for a period not to exceed
228 weeks, except that no employee may take a leave of absence under this subsection
23for the sole purpose of participating in partisan political activity. During any time
24in which an employee is on a leave of absence granted under this subsection, the
1appointing authority shall continue to make all required employer contributions for
2that employee, as well as any required employee contributions that the employer is
3required to make on behalf of that employee in accordance with a collective
4bargaining agreement under subchapter V of chapter 111 or section 230.12 of the
5statutes, for benefits provided under chapter 40 of the statutes. During the leave of
6absence, the employee's employment shall be considered not to have been
7interrupted for all purposes relating to wages, hours, and conditions of employment,
8except that the employee shall not be paid a salary. The timing of any leave of
9absence granted under this subsection shall be at the discretion of the appointing
10authority. Notwithstanding section 111.91 (1) of the statutes, for employees who are
11included in a collective bargaining unit for which a representative is recognized or
12certified under subchapter V of chapter 111 of the statutes, this subsection shall
13apply except as otherwise provided in a collective bargaining agreement.".".
