AB628,1,3 1An Act to renumber and amend 175.51 (1m) (b); and to create 175.51 (1m) (b)
21. and 2. and 343.252 of the statutes; relating to: referrals for subjects of alerts
3for missing adults and operator's license review.
Analysis by the Legislative Reference Bureau
This bill requires a law enforcement agency that has issued an alert for a
missing adult at risk, commonly known as a “Silver Alert," to refer the person making
the report and any guardian of the missing person to a local aging and disability
resource center. If the subject of such an alert was driving a vehicle when he or she
was reported missing, this bill also requires the law enforcement agency to notify the
Department of Transportation. If DOT receives such a notification, DOT must
review the driver's license of the person to determine if restrictions should be
imposed on the person's license for the safety of the person or the public.

The people of the state of Wisconsin, represented in senate and assembly, do
enact as follows:

1175.51 (1m) (b) (intro.) If a law enforcement agency receives a report of a
2missing adult at risk, the law enforcement agency shall use the form under s. 165.785
3(2m) (a) 1. to disseminate the report using the integrated crime alert network. The
4law enforcement agency shall confirm that the report was an appropriate subject for
5an alert under this subsection and shall do all of the following:

8person making the report, as well as any guardian or agent under an activated power
9of attorney for health care for the missing adult.
AB628,2,1310 2. If the law enforcement agency determines that the adult reported missing
11was operating a motor vehicle during the period when he or she was reported
12missing, notify the department of transportation of the identity of the adult for
13purposes of the review required under s. 343.252.
AB628,3 14Section 3. 343.252 of the statutes is created to read:
AB628,2,20 15343.252 Review of licenses after missing adult alert. If an individual who
16is the subject of a notification under s. 175.51 (1m) (b) 2. has an operator's license,
17the department shall review that individual's operating privilege and impose
18restrictions under s. 343.13 as the department determines will protect that
19individual and public safety, including cancelling a license or an endorsement under
20s. 343.25.
