36.11(29r)(29r)Economic development assistance reporting.
36.11(29r)(a)(a) In this subsection, “economic development program” means a program or activity having the primary purpose of encouraging the establishment and growth of business in this state, including the creation and retention of jobs, and that satisfies all of the following:
36.11(29r)(a)1.1. The program receives funding from the state or federal government that is allocated through an appropriation under ch. 20.
36.11(29r)(a)2.2. The program provides financial assistance, tax benefits, or direct services to specific industries, businesses, local governments, or organizations.
36.11(29r)(b)1.1. The board shall coordinate any economic development assistance with the Wisconsin Economic Development Corporation.
36.11(29r)(b)2.2. Annually, no later than October 1, the board shall submit to the joint legislative audit committee and to the appropriate standing committees of the legislature under s. 13.172 (3) a comprehensive report assessing economic development programs administered by the board. The report shall include all of the information required under s. 238.07 (2). The board shall collaborate with the Wisconsin Economic Development Corporation to make readily accessible to the public on an Internet-based system the information required under this subsection.
36.11(36)(36)Aquaculture demonstration facility. The board, in consultation with representatives of the aquaculture industry, shall operate the aquaculture demonstration facility authorized under 1999 Wisconsin Act 9, section 9107 (1) (i) 3.
36.11(40)(40)Center for cooperatives. The board shall maintain a center for cooperatives at the University of Wisconsin-Madison.
36.11(43)(43)Programming at University of Wisconsin-Green Bay. The board shall ensure that the University of Wisconsin-Green Bay implements programming that is jointly developed by the University of Wisconsin-Green Bay and the Oneida Tribe.
36.11(47)(47)Armed forces. If a student who is a member of a national guard or a member of a reserve unit of the U.S. armed forces withdraws from school after September 11, 2001, because he or she is called into state active duty or into active service with the U.S. armed forces, the board shall do all of the following:
36.11(47)(am)(am) Reenroll the student beginning in the semester in which he or she is discharged, demobilized, or deactivated from active duty or the next succeeding semester, whichever the student prefers.
36.11(47)(bm)(bm) Give the student the same priority in registering for courses that the student would have had if he or she had registered for courses at the beginning of the registration period.
36.11(47)(c)(c) At the student’s request, do one of the following for all courses from which the student had to withdraw:
36.11(47)(c)1.1. Reimburse the student all tuition and fees paid for all the courses and a prorated portion of room and board payments.
36.11(47)(c)2.2. Grant the student an incomplete in all the courses and permit the student to complete the courses, within 6 months after leaving state service or active service, without paying additional tuition or fees.
36.11(47)(d)(d) Ensure that the student is provided a reasonable opportunity to complete final projects and final examinations for all courses in which the scheduled end date of the course is not more than 30 days after the date of the order calling the student into active duty or service unless such an accommodation cannot be reasonably made.
36.11(47m)(47m)Service members; priority registration.
36.11(47m)(a)(a) In this subsection, “service member” means a person who has served or is serving on active duty under honorable conditions in the U.S. armed forces, in forces incorporated as part of the U.S. armed forces, in the national guard, or in a reserve component of the U.S. armed forces.
36.11(47m)(b)(b) The board shall ensure that a student who is a service member is given priority in registering for courses at any college campus or institution.
36.11(48)(48)Report on utility charges; assessment of certain utility charges. The board shall ensure that the University of Wisconsin-Madison reports annually to the department of administration on utility charges in the following fiscal year to fund principal and interest costs incurred in purchasing the Walnut Street steam and chilled-water plant enumerated under 2003 Wisconsin Act 33, section 9106 (1) (g) 2. and in renovating and adding an addition to the Charter Street heating and cooling plant enumerated under 2009 Wisconsin Act 28, section 9106 (1) (g) 3., and the methodology used to calculate those charges. The board may not assess the utility charges until the charges are approved by the department of administration.
36.11(50)(50)Reserve officer training corps. The board may not allocate general purpose revenue for the operation of an institution or college campus that prohibits the reserve officer training corps from operating on its campus.
36.11(51)(51)Automobile allowance. The board may not use general purpose revenue, tuition, or academic fees for the president’s or the chancellors’ automobile allowance.
36.11(52)(52)Midwestern Higher Education Compact dues. The board shall make full annual payments of membership dues to the Midwestern Higher Education Compact.
36.11(53m)(53m)Designation of building projects. The board shall not designate any part of a state building project that is subject to approval under s. 13.48 (10) (a) as a separate building project.
36.11(54)(54)Employee reports.
36.11(54)(a)(a) In this subsection, “backup position” means a position that the board is contractually required to provide for an employee who resigns or is terminated from his or her current position.
36.11(54)(b)(b) Annually, the board shall submit a report to the appropriate standing committees of the legislature under s. 13.172 (3) and to the governor that identifies the number of employees with limited appointments under s. 36.17 and rules promulgated thereunder, the number of employees with concurrent appointments, and the number of employees with employment contracts that require backup positions but who have not yet resigned or been terminated from their current positions.
36.11(55m)(55m)Classified research. The board may accept research contracts involving government security classifications or other similar restrictions on participation in research or access to or dissemination of research results, if all of the following are satisfied:
36.11(55m)(a)(a) The research furthers national security interests.
36.11(55m)(b)(b) The educational interests of all participating students are adequately protected.
36.11(55m)(c)(c) Appropriate facilities, infrastructure, and administrative resources are available for the research, either on campus or at off-campus locations.
36.11(55m)(d)(d) The sponsors of the research cover all additional costs associated with the security requirements of the research.
36.11(55m)(e)(e) The conditions for accepting the contracts and conducting the research are established pursuant to a process approved by the chancellor, in consultation with the faculty, of the institution at which the research is to be conducted.
36.11(56)(56)Travel policies. Effective July 1, 2013, the board shall establish travel policies for system employees and a schedule for the reimbursement of system employees for travel expenses. Beginning on January 1, 2018, except with respect to contracts in effect on that date, this schedule may not provide for reimbursement of system employees for lodging expenses incurred in this state at a rate that exceeds the maximum rate for lodging expenses incurred in the same location in this state under the approved uniform travel schedule incorporated under s. 20.916 (8) (b) into the current compensation plan under s. 230.12 (1).
36.11(57)(57)Classification of segregated fees.
36.11(57)(a)(a) The board shall revise its policies regarding student segregated fees to ensure that the classification of those fees as allocable or nonallocable is consistent across institutions.
36.11(57)(b)(b) The board shall submit the revised policies under par. (a) to the joint committee on finance. If the cochairpersons of the committee do not notify the board that the committee has scheduled a meeting for the purpose of reviewing the revised policies within 14 working days after the date of the submittal, the revised policies are considered approved and may be implemented. If, within 14 working days after the date of the submittal, the cochairpersons of the committee notify the board that the committee has scheduled a meeting for the purpose of reviewing the revised policies, the revised policies may be implemented only upon approval of the committee.
36.11(57)(c)(c) Notwithstanding s. 36.27 (1), the board may not approve an increase in the allocable portion of segregated fees at any institution until the joint committee on finance has approved the board’s revised policies in the manner provided in par. (b).
36.11(58)(58)Transfers to the University of Wisconsin Oshkosh Foundation. The board may not transfer funds to the University of Wisconsin Oshkosh Foundation, Inc., unless the transfer is first approved by legislative enactment.
36.11 AnnotationThe Board of Regents has the power to make reasonable rules governing student use of automobiles on university property and can enforce them by imposing reasonable monetary penalties and withholding records. A student court can be designated by the board as an auxiliary enterprise. Moneys collected must be paid into the general fund. By regent action, they may be appropriated therefrom for operation of that activity. 59 Atty. Gen. 82.
36.11 AnnotationThe University of Wisconsin System may sell a dormitory that no longer is needed for educational purposes upon terms that are agreeable to the Wisconsin state agencies building corporation and H.U.D. to guarantee the payment of the bonds issued for the initial construction of the building. 63 Atty. Gen. 252.
36.11 AnnotationCampus police have jurisdiction under sub. (2) to arrest only on campuses unless deputized by a sheriff. Local ordinances are not applicable on campus. 68 Atty. Gen. 67.
36.11236.112Performance funding; innovation fund.
36.112(1)(1)Definition. In this section, “institution” includes the extension.
36.112(2)(2)Goals; metrics.
36.112(2)(a)(a) The legislature hereby establishes the following goals for the system:
36.112(2)(a)1.1. Growing and ensuring student access.
36.112(2)(a)2.2. Improving and excelling at student progress and completion.
36.112(2)(a)3.3. Expanding contributions to the workforce.
36.112(2)(a)4.4. Enhancing operational efficiency and effectiveness.
36.112(2)(b)(b) For each goal specified in par. (a), the Board of Regents shall identify at least 4 metrics to measure an institution’s progress toward meeting the goal. As the Board of Regents determines is appropriate, the board may specify different metrics for the extension.
36.112(3)(3)Outcomes-based funding formula.
36.112(3)(a)(a) The Board of Regents shall develop a formula for distributing under par. (b) the amount allocated under sub. (4) among the institutions based on each institution’s performance with respect to the metrics under sub. (2) (b).
36.112(3)(b)(b) By no later than February 15, 2018, the Board of Regents shall submit the formula developed under par. (a) to the joint committee on finance. The Board of Regents may use the formula to distribute the amount allocated under sub. (4) among the institutions only as modified or approved by the committee. The joint committee on finance shall consult with the appropriate standing committee in each house before modifying or approving the formula.
36.112(4)(4)Allocation. In each fiscal year beginning in fiscal year 2018-19, the Board of Regents shall allocate $26,250,000 of the amount appropriated under s. 20.285 (1) (a) to distribute to institutions under the formula under sub. (3) (b).
36.112(5)(5)Report.
36.112(5)(a)(a) Beginning in fiscal year 2018-19, the Board of Regents shall submit an annual report to the joint committee on finance that describes how the Board of Regents distributed in the fiscal year the amount allocated under sub. (4) to the institutions under the formula under sub. (3) (b). The report shall describe all of the following:
36.112(5)(a)1.1. The amount distributed to each institution under the formula in the fiscal year.
36.112(5)(a)2.2. The performance of each institution with respect to all the metrics identified by the Board of Regents under sub. (2) (b).
36.112(5)(a)3.3. The methodology used to make the distributions based on each institution’s performance with respect to the metrics.
36.112(5)(a)4.4. The performance of the system as a whole with respect to all the metrics identified by the Board of Regents under sub. (2) (b).
36.112(5)(a)5.5. Any other information used to administer the requirements of this section.
36.112(5)(b)(b) The Board of Regents shall make the report required under par. (a) available to the public, and each institution shall post the report on its Internet site.
36.112(6)(6)Innovation fund. In fiscal year 2017-18, the Board of Regents shall allocate $5,000,000 of the amount appropriated under s. 20.285 (1) (a) for the board to distribute to institutions to increase enrollments in high-demand degree programs. The Board of Regents shall make the distribution through a competitive process involving a request for proposals from the institutions.
36.112(7)(7)Other duties. The Board of Regents shall do all of the following:
36.112(7)(a)(a) Identify baseline data sets for the goals specified in sub. (2) (a).
36.112(7)(c)(c) Approve a peer group for each institution that includes institutions of higher education with comparable missions and service populations.

36.11536.115Personnel systems.
36.115(1)(1)In this section:
36.115(1)(a)(a) “Chancellor” means the chancellor of the University of Wisconsin-Madison.
36.115(1)(b)(b) “State specialists” means faculty or academic staff at the University of Wisconsin-Platteville, University of Wisconsin-River Falls, University of Wisconsin-Stevens Point, or University of Wisconsin-Madison College of Agricultural and Life Sciences with appointments partially or fully funded through the division of extension at the University of Wisconsin-Madison in the field of applied agricultural research.
36.115(2)(2)Except as provided in sub. (8), the board shall develop a personnel system that is separate and distinct from the personnel system under ch. 230 for all system employees except system employees assigned to the University of Wisconsin-Madison.
36.115(3)(3)Except as provided in sub. (8), the chancellor shall develop a personnel system that is separate and distinct from the personnel system under ch. 230 for all system employees assigned to the University of Wisconsin-Madison.
36.115(3m)(3m)The board shall set the salary ranges for all of the following positions:
36.115(3m)(ae)(ae) Each of the vice chancellors who is serving as deputy at the University of Wisconsin System campuses at Eau Claire, Green Bay, La Crosse, Oshkosh, Parkside, Platteville, River Falls, Stevens Point, Stout, Superior, and Whitewater and each of the vice chancellors who is serving as deputy at the University of Wisconsin Colleges and the University of Wisconsin-Extension.
36.115(3m)(am)(am) The vice presidents of the University of Wisconsin System.
36.115(3m)(ar)(ar) The chancellors at the University of Wisconsin System campuses at Eau Claire, Green Bay, La Crosse, Oshkosh, Parkside, Platteville, River Falls, Stevens Point, Stout, Superior, and Whitewater and the chancellors of the University of Wisconsin Colleges and the University of Wisconsin-Extension.

36.115(3m)(bm)(bm) The senior vice presidents of the University of Wisconsin System.
36.115(3m)(c)(c) The vice chancellor who is serving as deputy at the University of Wisconsin-Madison.
36.115(3m)(d)(d) The chancellor at the University of Wisconsin-Milwaukee.
36.115(3m)(e)(e) The chancellor at the University of Wisconsin-Madison.
36.115(3m)(f)(f) The president of the University of Wisconsin System.
36.115(3m)(g)(g) The associate and assistant vice presidents, vice chancellors not identified in pars. (ae), (b), or (c), assistant chancellors, associate and assistant vice chancellors, and administrative directors and associate directors of physical plant, general operations and services, and auxiliary enterprises activities or their equivalent, of each University of Wisconsin institution, the University of Wisconsin-Extension, and the University of Wisconsin System administration.
36.115(4)(4)The personnel systems developed under subs. (2) and (3) shall include a civil service system, a grievance procedure that addresses employee terminations, and provisions that address employee discipline and workplace safety. The grievance procedure shall include all of the following elements:
36.115(4)(a)(a) A written document specifying the process that a grievant and an employer must follow.
