3together for the purpose of selling goods or services.

5consumers from house to house, on any street, or in any other place that is open to
6the public or related support work.
SB40-SSA1-SA1,156,77 (f) "Traveling sales crew worker" means a member of a traveling sales crew.
SB40-SSA1-SA1,156,18 8(2) Registration required. No person may employ, offer to employ, or
9otherwise recruit an individual to work as a traveling sales crew worker without first
10obtaining a certificate of registration from the department. To obtain a certificate
11of registration, a person shall complete an application under sub. (3) (a), meet the
12minimum requirements specified in sub. (3) (c) for issuance of a certificate of
13registration, and pay a registration fee determined by the department by rule
14promulgated under sub. (13). A certificate of registration is valid for 12 months
15unless sooner suspended, restricted, or revoked and is nontransferable. A registrant
16may renew a certificate of registration by submitting an application under sub. (3)
17(a) and paying the registration fee not less than 30 days before the expiration date
18of the certificate of registration.

20person shall complete an application that contains all of the following information:

2addresses, and telephone numbers of the publishers of those magazines.

4applicant's traveling sales crew workers, including the type and license number of
5each motor vehicle, and documentation showing that each motor vehicle is in

9crew workers will include the storage, handling, or transportation of hazardous
10materials or may result in any other exposure of those workers to hazardous
11materials and, if so, documentation showing that the applicant is in compliance with
12all state and federal safety standards that are applicable to the storage, handling,
13and transportation of the hazardous materials as provided in sub. (7) (b).

15complied with the proof of financial responsibility requirement under sub. (4), the
16disclosure statement requirement under sub. (5), and the proof of insurance
17requirement under sub. (8).

19protection of the health, safety, and welfare of the traveling sales crew workers
20employed by the applicant.
SB40-SSA1-SA1,159,621 (b) 1. On receipt of an application under par. (a) and payment of the registration
22fee under sub. (2), the department of workforce development shall investigate the
23applicant to determine whether the applicant is qualified under par. (c) to receive a
24certificate of registration. That investigation shall include a criminal history search
25by the department of justice of all proprietors, managing partners, managers, or

1principal officers of the applicant, and of all employees, agents, or representatives
2of the applicant who supervise or transport traveling sales crew workers. That
3investigation shall also include a search by the department of workforce
4development to determine whether any of those individuals has committed a
5violation of s. 100.18, 100.195, or 100.20, of a rule promulgated under any of those
6sections, or of a substantially similar federal law or law of another state.
SB40-SSA1-SA1,159,187 2. If the person being investigated is, or at any time within the 5 years
8preceding the date of the application has been, a nonresident or if the department
9of workforce development determines that any information obtained as a result of
10the investigation under subd. 1. provides a reasonable basis for further
11investigation, the department of workforce development may require the person
12being investigated to be fingerprinted on 2 fingerprint cards, each bearing a complete
13set of the person's fingerprints. The department of justice may provide for the
14submission of the fingerprint cards to the federal bureau of investigation for the
15purposes of verifying the identification of the person and obtaining the person's
16criminal conviction record. The department of workforce development shall keep
17confidential all information received from the department of justice and the federal
18bureau of investigation under this subdivision.
SB40-SSA1-SA1,159,2419 (c) Subject to par. (d) and sub. (10) (b) and (c), after completing the investigation
20under par. (b), the department shall issue a certificate of registration to the applicant
21if the department determines that the applicant meets the minimum requirements
22under this section and rules promulgated under sub. (13) for issuance of a certificate
23of registration and is satisfied that the applicant will comply with this section and
24those rules.

1(d) The department may deny, suspend, revoke, restrict, or refuse to renew a

25comply with an order of the department imposed as a result of a violation of this

1section or any rule promulgated under sub. (13); or otherwise failed to comply with
2this section or any rule promulgated under sub. (13).
SB40-SSA1-SA1,161,53 (e) If any change occurs in any of the information submitted to the department
4under par. (a), the registrant shall notify the department of that change within 30
5days after the change occurs.
SB40-SSA1-SA1,161,126 (f) A registrant and all employees, agents, or representatives of a registrant
7who supervise or transport traveling sales crew workers shall carry at all times while
8engaging in traveling sales crew activities a copy of the registrant's certificate of
9registration and shall exhibit that copy upon the request of any deputy of the
10department, law enforcement officer, or person with whom the registrant, employee,
11agent, or representative is doing business. Failure to exhibit that copy upon that
12request is prima facie evidence of a violation of this section.
SB40-SSA1-SA1,161,15 13(4) Financial responsibility. (a) An applicant shall establish proof of its ability
14to pay any compensation owed to a traveling sales crew worker employed by the
15applicant and any penalties that may be imposed under sub. (12).
SB40-SSA1-SA1,161,1816 (b) An applicant shall prove its ability to pay under par. (a) by maintaining one
17of the following commitments in an amount approved by the department, but not less
18that $10,000, and in a form approved by the department:

24payable to the department, for the benefit of the state and any traveling sales crew
25worker who does not receive the compensation earned by the worker. The applicant

1shall file with the department any agreement, instrument, or other document
2necessary to enforce the commitment against the applicant or any relevant 3rd party,
3or both.
SB40-SSA1-SA1,162,10 4(5) Disclosure statement. (a) At the time an individual is offered employment
5as a traveling sales crew worker or is otherwise recruited to work as a traveling sales
6crew worker, the employer shall provide the individual with a written disclosure
7statement of the terms of employment. If the individual accepts the offer of
8employment, the employer and the individual shall sign the written disclosure
9statement. A written disclosure statement shall include all of the following
10information:
